In 2010, serial rapist Darryl Durr argued he might be violently allergic to the state's execution drug.
Each time, U.S. District Court Judge Gregory Frost, a veteran of the state's capital punishment legal challenges, ultimately allowed the execution to proceed. In his latest ruling, he said Monday that McGuire had failed to present evidence he would suffer breathing problems alleged by his attorneys a phenomenon known as "air hunger" and said the risk to McGuire is within constitutional limits.
That said, Frost acknowledged the novelty of Ohio's never tried two-drug combination, calling it "an experiment in lethal injection processes."
But until a method violates the Constitution, "The law teaches that Ohio is free to innovate and to evolve its procedures for administering capital punishment," Frost said.

Just for the record, I oppose the DP, not on moral grounds, but it's much cheaper to give this guy life w/o parole.

(13,598 posts)The problem with the death penalty is that it's operated by fallible mortals, and therefor *any* country that applies it will, *inevitably*, occasionally execute people who are either not guilty or guilty but not to the extent where it's appropriate.
How many innocent people are you willing to see wrongfully killed in order to get just a little more revenge than life without parole would provide?

(5,857 posts)hydromorphone is a synthetic opiod that's much stronger than morphine. Versed is a drug used to render people unconscious for surgery.
I don't like the death penalty, but I can't see how this drug combination is any worse than others that have been used for decades.

Workers have lost their lives or been overcome by
exposure to high concentrations of gases that do not
support life. Oxygen is the only component of the air
we breathe capable of supporting life. Air is composed
of approximately 21% oxygen, 78% nitrogen and
other trace components. Asphyxiation is the greatest
hazard associated with nitrogen and other inert gases,
such as argon and helium. However, the addition of
any gas, except oxygen, to air reduces the oxygen
concentration through displacement and dilution.
Breathing as little as one or two breaths of air containing
too little oxygen can have serious and immediate
effects, including unconsciousness. Because there are
no warning signs of reduced oxygen concentrations,
these environments are extremely dangerous

I am against the death penalty, but why all the rigmarole with injections? It would be easy enough to design a room that allows the oxygen level to be lowered without causing the convict any distress.

Durr kidnapped 16-year-old Angel Vincent from her home while her parents were away. He raped and strangled her with a dog chain and hid her body inside two orange traffic barrels placed end-to-end in a Cleveland park. Durr fathered a child with a teenage girlfriend who lived down the street from the victim and was obsessed with her. He named his newborn daughter Angel, and even made his girlfriend model the jeans he had removed from his victim the night she was abducted. The victim's decomposed body was discovered by neighborhood kids three months later. The case remained unsolved until Durr was arrested on two unrelated rapes in September 1988. His girlfriend, Deborah Mullins, came forward and told authorities that Durr had picked her up the night Vincent disappeared. Vincent was tied up in the back of the vehicle, Mullins said, and Durr said he was going to "waste" her. Durr dropped her off at an apartment, then returned about four hours later and placed Vincent's ring and bracelet on a coffee table. Durr boasted that he had strangled Vincent. Durr was convicted largely on the testimony of Mullins, who said she waited months to tell police about the murder out of fear that Durr would harm her. Prosecutors said Mullins knew facts about the case that she could not have known without Durr telling her, including the location of the body.
