Kill Unarmed Man First, Ask Questions Later: Anaheim Cop Lawyer


An unarmed, 25-year-old man not wanted for any crime was exercising his constitutional rights to move away from Anaheim Police Department (APD) officers when 20 seconds later one of the cops, armed with a semi-automatic Glock, decided without warning to kill him with shots to the buttock and back of the head.

That's the story Dale K. Galipo, an attorney for the estate of Manuel Diaz, told a jury of six men and two women in his Feb. 25 opening statement at the excessive force and wrongful death trial inside U.S. District Court Judge James V. Selna's Santa Ana courtroom.



"Mr. Diaz had nothing in his hands," Galipo said. "He was no threat when he was shot [in the buttock]. As he was going down to his knees, there was a second shot to his head . . . Diaz landed face down. The officers handcuffed him, patted him down and didn't find a weapon. They never found a weapon."

Steven Rothans, a Los Angeles-based lawyer that specializes in defending law enforcement agencies and cops in police brutality cases, told jurors that officer Nick Bennallack, had every right to kill Diaz because, even though he never saw the man holding a weapon, he "reasonably" assumed he had one in his waistband and might have been preparing to shoot.

justify their murderous assaults. Infuckingsane to me. You cannot stand your ground when the cops want to put you in it.

ground. My gut tells me to punch a bully in the mouth or the bullying will never cease. My point is that isn't an option. My point is there is no option, only a bloody aftermath and the cops aren't the one's bleeding. I'm rageful over it and I want to know what to do. How does won protect themselves from being murdered by cops except by avoiding them altogether?

Kelly Thomas.

There is a 31 minute video of him being beaten and tazed repeatedly by 6 officers.

He was in a comma for 5 days.

He died.

He did absolutely NOTHING and the video proved this beyond a shadow of a doubt.

It showed one of the officers putting on latex gloves.

He asked Kelly Thomas "Do you see my fists".

"They are getting ready to FUCK YOU UP."

Kelly Thomas was a schizophrenic.

Kelly Thomas was sitting on the curb, and replied "Start punching".

He was beaten in the face with the taser gun.

The jury found all the officers NOT GUILTY.

Just Google Kelly Thomas and the photos and video are on the first page.

it is bad in many areas of this country.

Yesterday I put up a blurb remembering Oscar Grant III (http://www.democraticunderground.com/10244165). I initially wrote about him a couple of years ago - prior to the Trayvon Martin case. I don't think I want to know exactly how many of these cases there are every year. Occasionally someone writes an article and we hear about them, but other than that their families grieve and the police force is "back to business" as usual. It's sickening.

According to the Officer's Attorney "...who essentially asked to be executed by not following police commands to stop and get on the ground."

I'm beginning to wonder if we would be better off without cops at all. It seems they are just as likely to hurt you as to help you.
