There are clearly a total of 7 shots fired. Two of them BEFORE he turns and moves towards the car door.
If the first 5 were beanbags, that could explain him trying to flee back to the car. You don't enjoy getting hit with them. |

It's clear from the video he was shot shortly after turning his back and raising his hands. I can't quite be sure how long after he raised his hands the fatal shots were fired; from the youtube, I would very crudely gauge it as about a second, but mine is an estimate with no real precision There are some neural delays in conscious detection of an event and in the formation of conscious intent to act; and presumably there are similar delays when forming a conscious decision not to engage in an intentional act that one has already decided to undertake. Unfortunately, I can't speak with any precision on the science there; in one of the links I've provided in this thread, a police chief suggests that the total time required to change one's mind in such a situation might be 1.5 sec; I don't know if that estimate is supported by research I would assume that conscious detection of an event and conscious intent to act do not involve precisely the same cerebral centers, so if (say) it takes 0.5 sec to perceive an event and another 0.35 sec to form intent to act, it is plausible that combination could require 0.85 sec. And I might expect decision not to act after all, based on changing perceptions, could take at least the same amount of time and perhaps more, since the changed decision presumably requires resolving signal conflicts. So if the deputy saw the man his back to the police but his hands down and out of sight, believed the man armed and erratic, he might have made a decision to shoot based on (say) some hand and body motion that he misunderstood as the man turning to open fire On viewing the video alone, I wouldn't call it a justifiable shooting -- but under stressful conditions, when one's attention is concentrated on aiming at a suspect thought to be armed and erratic, I don't know how long it takes to form an accurate assessment of a changing situation and make a defensible decision about how to respond. If the shots range out about 3 sec after the man had raised his hands, I'd call it manslaughter; if the shots were fired about 0.5 sec after the man began to turn his back to the officers, I'd probably call it suicide-by-cop; if the shots were fired more than 0.85 sec after the man began to raise his hands, we're in a vast gray area where I lack the knowledge needed to make a call Ciba Found Symp. 1993;174:123-37; discussion 137-46. The neural time factor in conscious and unconscious events. Libet B. Abstract Our earlier evidence had indicated that a substantial duration of appropriate cerebral activity (up to about 0.5 s) is required for the production of a conscious sensory experience; this means the sensory world is experienced delayed with respect to real time ... Our experimental finding that conscious intention to act appears only after a delay of about 350 ms from the onset of specific cerebral activity that precedes a voluntary act provided indirect evidence for the theory. I agree, the officer that shot him likely decided at that point, to shoot rather than allow him to get in the car, and begin the chase again. I completely agree with your time delay/decision/action analysis.
With the conditions at that point in time in mind, I think I can understand the shooting justification in his mind to the point I wouldn't slap him with criminal charges, but I think I would retire him from police duty, and this incident needs to become a training tool. 3 officers were close enough to physically close with him and prevent him from getting in the vehicle. Two were so close you could hear them screaming 'crossfire' at each other, because if they had to open up, some of the other officers didn't have a clear shot due to their proximity. I mean, really all it would take is a kick to his car door to prevent him from getting in. Rather than grappling, they opted to hit him with beanbags... Taser may have hit a thick bit of clothing and failed to penetrate his skin. That happens plenty. |

25. This is a tough one.
I suppose I will be a dissenting voice here to say that it is not as cut and dry as anyone would like. Officers had information that he had a gun. He told officers on scene of the stop that he had a gun and that they were going to have to shoot him. He turns to re-enter the car after a standoff. Officers start peppering him with less lethal rounds. They would have been justified in shooting him here. As he turns around and throws his hands up after coming out of the door of the car, the officer made a decision in less than a second to fire his gun.

He turned towards his car with a slight crouch from bean bag hits, then turns showing his back and stands straight up with hands in the air with NOTHING in either hand. That is not coming out the door. It might be tough one for pea shooters like you, but not for the normal world. |

Always videotape encounters with police. Even if you are killed your relatives may have recourse like Otto Zehm of Spokane, Wa. There is a rash of these unrighteous murders going on. I just watched a video on DU yesterday where a man was crushed by at least 7 cops.

The Pinal County sheriff's office issued a statement justifying the shooting, which statement omits the fact that the man's hands were in the air when he was shot. If it weren't for that citizen's video, those cops would clean get away with cold blooded murder. The article at the link provides an HONEST police officer's interpretation of the video:

which IMO is when a cop would shoot him. For some reason, he backs away from the drivers side of the car toward police and as SOON as his hands go up in the air (nothing in his hands) - two shots take him down from the left. I don't think he died instantly either because you can see his leg move for a bit then go limp.

It was spotted about noon on the 14 February. Police reported around 1P that the driver told the police "he wants us to shoot him at Main and 11th" (where the shooting occurred later) and indicated by gesture he had a gun. There was a high speed chase, ending after about 40 minutes near Main and 11th, where the man's girlfriend lived. The man exited the vehicle and stood facing officers with one hand behind his back. Officers fired five beanbags and a taser at him. He moved towards the front of the car and may or may not have opened the front door of the vehicle to reach inside. He then returned towards the rear of the vehicle, turned his back on police, and raised his hand. About a second later, a deputy fired two rifle shots; one hit him in the back below the left shoulder blade. At about this time, off-duty Deputy Guy Cariņo (brother of the man's girlfriend) tried to calm the man; Cariņo was forcibly removed from the vicinity and charged with assaulting officers and endangering officers; he was fired the next day for a domestic abuse incident in September, for which he had been served a termination notice in January.
