Strangely enough, nobody at any of the popular media outlets knows either. Because a responsible journalist would evince extreme skepticism toward anyone who threatened a lawsuit without being able to specify a cause of action. Instead, we're treated to breathless, screaming headlines about how Boehner is going to sue the President. Sue, sue, sue!

Boehner now doesn't have to do one more goddam thing. The water has been carried, and certain members of the public will drink deeply to yammer on about how the president got all sued and stuff. It will soon pass into accepted political lore, and the likes of David Gregory, George Stephanopolous and Chris Matthews will all nod sagely when the canard waddles out and quacks.

He is incapable of making a call like that. He's waiting for his billionaire to tell him what to do. Either way he goes it's a win for the dems.
