BREAKING: Judge declares Florida's ban on same-sex marriage unconstitutional!

Monroe County Circuit Judge Luis Garcia overturned Florida’s 2008 constitutional gay-marriage ban on Thursday, and ordered that two Key West bartenders be allowed to wed but not before Tuesday.

Aaron Huntsman and William Lee Jones, who met at a gay pride celebration and have been a couple for 11 years, sued Monroe County Clerk Amy Heavilin in April for a marriage license. Their case mirrors a similar suit in Miami-Dade County, in which six same-sex couples and LGBT advocacy group Equality Florida Institute sued County Clerk Harvey Ruvin for the right to marry.

In both cases, Florida Assistant Attorney General Adam Tanenbaum argued that Garcia and Miami-Dade Circuit Judge Sarah Zabel should not dismiss Florida’s constitutional gay marriage ban, which passed in 2008 with the support of 62 percent of voters.

“It remains for this court simply to respect the policy decision made by voters,” Tanenbaum told Garcia at a hearing for summary judgment on July 7 in Plantation Key.

Zabel has yet to rule on whether to allow the Miami-Dade plaintiffs to wed or go to trial in their suit against Ruvin. The six couples are Catherina Pareto and Karla Arguello of Coconut Grove; Dr. Juan Carlos Rodriguez and David Price of Davie; Vanessa and Melanie Alenier of Hollywood; Todd and Jeff Delmay of Hollywood; Summer Greene and Pamela Faerber of Plantation; and Don Price Johnston and Jorge Isaias Diaz of Miami.

But we've won more than 20 legal decisions around the country since the SCOTUS struck down DOMA last year. Many of those rulings remain in various stages of appeal including here in WI.

where the mayor spoke and gave kudos and credit to Judge Garcia, which was met by cheers from the crowd. I've served on jury duty under Garcia and he is a gem. We were deliberating a case that had to do with property lines and the jury was taken to the property (woods and swamp) by bus. Garcia rode with us and personally sprayed us all down with OFF before we entered the property. So considerate.

Anyway, it was a lovely celebration, only slightly marred by talk of the appeal by Bondi.

But I bet it's a different story a few miles south of us in Key West. I bet they are raising the rafters and will be well into the night. 😄

of Pride Fest. The Milwaukee County executive offered to personally pay for overtime for staff to issue marriage certificates through the weekend. The police delivered cake in Madison, hundreds of couples married those glorious few days, including some friends of mine. Pure joy! Have you seen "The Case Against 8"? The end when the AG ordered the LA clerks office to start issuing licences immediately, and she told them to take it all in because it's going to be an amazing day... I'm crying just thinking about it. Beautiful.

and now in her third relationship (they had a "non-legal ceremony&quot under her sanctity belt, lol.

I'm loving the irony... Gay couples can't marry legally because politicians garnering favor from wack-a-doodles are blocking their rights. SHE can't marry legally because it would be political suicide for her to have the baggage of three husbands while pounding her fists on the pulpit for the sanctity of marriage.

I would just remind him that the Jim Crow laws were overwhelmingly supported by the local voters.
