Florida will defy a federal warning to stop purging people the state suspects aren't U.S. citizens from voter registration rolls.

Despite a Justice Department letter, objections from county elections officials and evidence that a disproportionate number are voters of color, Florida Secretary of State Ken Detzner's office planned to continue scrubbing the election rolls, a spokesman said Friday. Gov. Rick Scott (R) ordered the search for potentially ineligible voters.

“We have an obligation to make sure the voter rolls are accurate and we are going to continue forward and do everything that we can legally do to make sure than ineligible voters cannot vote,” said Chris Cate, a spokesman for Detzner. “We are firmly committed to doing the right thing and preventing ineligible voters from being able to cast a ballot. We are not going to give up our efforts to make sure the voter rolls are accurate."

Justice Department officials declined to comment on Florida’s plans.

5. I'm often cynical about Obama's willingness to confront, but I think he'll come through on this one.

The script is already written:
DoJ warns.
Florida defies.
DoJ brings federal lawsuit.
Federal judge issues preliminary injunction telling Florida to desist.
Governor denounces activist judges and federal interference and the actions of the "Democrat Party" in shielding vote fraud.
Governor gets to play to the RW base with no downside except forcing federal and state taxpayers to pay expenses of litigation that should never have happened.

If you don't get what you want, first defy laws and logic.
If that fails throw a temper tantrum worthy of a three year old.
If that doesn't work; lie, mislead and cheat.
Failing that just do the best you can to entangle the entire area.

Then plan out some other way to lie, cheat and steal to get what you wanted in the first place.

Sometimes their chief purpose is to achieve a particular substantive result. Sometimes, though, it's just grandstanding.

For Rick Scott this has probably become a version of George Wallace's "stand in the schoolhouse doorway" moment. Wallace's purpose wasn't to prevent integration -- he knew he couldn't do that. His purpose was to be seen as fighting for his objective against an oppressive federal government.

From that point of view, Wallace's "temper tantrum worthy of a three year old" worked. The black students got into the University of Alabama, but Wallace gained national prominence as a leader of the white racist forces. Scott will probably settle for a similar outcome.

Scott is bluffing. His independently elected county supervisors have been advised by their lead lawyer to halt the purges until Justice and Florida resolve the challenge.

This is a sloppy article which doesn't take the actions of the lead counsel for the supervisor into account. All it does is regurgitate Scott and his honcho's attempt to look defiant in the face of the Justice Sept. warning. The lead counsel advised the supervisors to halt the purge and the president of the association of supervisors said SHE believes ALL 67 supervisors will listen to their lawyer.


TALLAHASSEE — A lawyer for Florida’s local election officials on Friday advised them to stop the effort to identify and purge ineligible voters until its legality is resolved.

State Association of Supervisors of Elections president Vicki Davis, the supervisor in Martin County, said she believed all 67 supervisors will listen to their legal adviser, Ron Labasky. With the exception of Miami-Dade County’s appointed supervisor, they are independently elected officials.

“It’s illegal under federal law, and I’m going to follow the law,” said Ion Sancho, the supervisor in Leon County.

anything about Defying Federal Warning or continuing with the recently attempted purge. She simply said "“We have an obligation to make sure the voter rolls are accurate and we are going to continue forward and do everything that we can legally do to make sure that ineligible voters cannot vote,” To me, that just says they'll find some way to do it LEGALLY. We shall see.

There are two things going on here: the actual rights of citizens to vote, which are not being infringed so long as the Supervisors refuse to pass on the purge lists. In that respect, we agree.

There is another issue, though, a 10th Amendment issue. Whatever the outcome on the ground, so long as Mr Scott or his subordinates defy the DoJ, we have a clear case of a state refusing compliance with Federal law. Overt defiance really has to be dealt with, or the Executive loses all kinds of credibility, which it can hardly afford. Presumably Mr Scott will back down at some point, after he has milked his grandstand play for all it is worth to his base. I submit, however, that if the Executive meekly allows him to get away with his George Wallace moment, the Executive loses.
