Bundy refuses in court to recognize U.S. authority in Nevada

Las Vegas • Jailed Nevada rancher Cliven Bundy refused Thursday to acknowledge federal authority and declined to enter a plea to federal charges that he led an armed standoff against a round-up of cattle two years ago.

After several minutes of confusion about whether Bundy had a lawyer, U.S. Magistrate Judge Carl Hoffman entered a not guilty plea on Bundy's behalf and scheduled a detention hearing March 17.

Arguments then will focus on whether the 69-year-old Bundy should remain in custody pending trial on 16 charges, including conspiracy, assault and threatening a federal officer, obstruction and firearms offenses.

It could be many months before trial. Federal prosecutor Steven Myhre told the judge the case involving 19 defendants would be slow-tracked as "complex" ...

From the Nevada Constitution:

Sec:?2.??Purpose of government; paramount allegiance to United States.??All political power is inherent in the people Government is instituted for the protection, security and benefit of the people; and they have the right to alter or reform the same whenever the public good may require it. But the Paramount Allegiance of every citizen is due to the Federal Government in the exercise of all its Constitutional powers as the same have been or may be defined by the Supreme Court of the United States; and no power exists in the people of this or any other State of the Federal Union to dissolve their connection therewith or perform any act tending to impair subvert, or resist the Supreme Authority of the government of the United States. The Constitution of the United States confers full power on the Federal Government to maintain and Perpetuate its existance , and whensoever any portion of the States, or people thereof attempt to secede from the Federal Union, or forcibly resist the Execution of its laws, the Federal Government may, by warrant of the Constitution, employ armed force in compelling obedience to its Authority.

In other words, Nevada agrees that the Federal Government is over any other law in the country and that the Federal Government has the right to use armed force to make idiots obey federal laws.

Cliven may think he's a lawyer but he apparently has never read the laws of his own state.

Most of these guys who claim to be Constitutional experts have never read the Constitution or don't understand what it says. To claim they recognize the law of Nevada and not know what Nevada's Constitution says proves how ignorant and delusional Cliven Bundy is.

I've only been to Nevada once in my life and I know what it's Constitution says about the Federal Government - and why. Nevada became a state in 1864 and the US government wanted to make sure that they recognized the right of the federal government to enforce the US Constitution and federal laws. A number of states admitted around the time of the Civil War or re-admitted afterwards have provisions such as this to prevent them from having a legal claim to succession.

If they weren't so intellectually dishonest, I might be willing to hear them out. Instead it's hyperbole & rhetoric, making little sense.

They are frauds.

If they truly are worried about the Constitution, then let's discuss government over-reach on data collection. That is real & compelling.

Hansen, who has been active in the Independent American Party, an ultra-conservative political organization, told Hoffman that he wants to remain as Bundy’s lawyer, but he needs to be paid ...

Mexico's claims to that region. Beginning in 1849, Mormons began to propose "Deseret" as a US state but part of the region became Utah Territory in 1850. Various remaining tensions led to the Mormon Rebellion of 1857-1858, involving various murders across Utah territory and leading to the removal of Brigham Young as governor of the territory

The major skirmish with the Paiute in Nevada was the Pyramid Lake War in 1860

Nevada (mostly carved from Utah territory) became a state in 1864

Cliven likes to claim that his family was there in 1877. This date seems to coincide with the first settlement of Bunkerville. But the major issues of national supremacy under US and Nevada law should be regarded as having been settled at the time

Cliven also likes to claim that his rights come from a time before the BLM was created in 1946. But Cliven was born in 1948; Cliven's parents bought the ranch in 1948; and the Bundy family didn't start grazing there until 1954. So it's quite hard to see how he could have inherited rights on that land from the 1870s; and the BLM has not only been around longer than that land has been in his family, and longer than his family has been grazing that land, but also longer than Cliven has been on earth
