(51,129 posts)The name precedes Disney using it, so sue Disney first for stealing the name.

Disney is suing the Academy of Motion Picture Arts and Sciences, contending the song-and-dance routine by a Snow White look-alike looked, well, dopey.
Corporate spokesman Erwin Okun said the performance was unflattering to the beloved character and the academy lacked permission to use the fairy tale character.

Disney, which has a reputation for zealously protecting its trademark characters, files dozens of suits each year against individuals and companies that copy its characters, especially on consumer products.
''We sue all the time,'' Okun said.
***
The suit alleges copyright infringement, unfair competition and violation of California's anti-dilution law, which protects the value of trademarks.

The legend of Snow White is believed to date back to Medieval times (so 1700s would presumably be well within Disney's domain ), and was published by the Brothers Grimm in 1812. Presumably Disney has copyrighted the particular appearance of Snow White seen in SWATSD and their theme parks, comics, etc. Note Disney only sued for 'cease and desist', not damages. Would they do the same over Pocahontas.com ? I think not, but I wouldn't have predicted any of their other lawsuits, either.

(284 posts)Disney can't own it.
Pocahontas (born Matoaka, known as Amonute, and later known as Rebecca Rolfe, c. 15961617) was a Native American[2][3][4] notable for her association with the colonial settlement at Jamestown, Virginia. Pocahontas was the daughter of Powhatan, the paramount chief[2] of a network of tributary tribal nations in the Tsenacommacah, encompassing the Tidewater region of Virginia. In a well-known historical anecdote, she is said to have saved the life of an Indian captive, Englishman John Smith, in 1607 by placing her head upon his own when her father raised his war club to execute him. Some historians have suggested that this story, as told by Smith, is untrue.[5]

(423 posts)The main reason they probably withdrew the application, is that someone in the boardroom woke up and realized
whom they were fucking with.
Walt Disney has withdrawn its application to trademark Seal Team 6, the name of the elite unit that killed Osama bin Laden, after the US navy moved to protect its rights and the entertainment giant endured a wave of criticism.
Disney sought the trademark rights on 3 May, two days after US operatives raided a compound in Pakistan and killed the man behind the September 11 attacks.
Disney's ABC subsidiary wanted to develop a TV show along the lines of NCIS and JAG, which are also real-life navy units, and would have focused on the drama and heroism of the special forces unit.
But the move was criticised for not only its rapid filing, but also for a trademark application that included items such as Christmas stockings and snow globes.

(745 posts)You don't think that Apple made "rounded corners" and "Icons" or that "Swipe to Unlock" functionality was first introduced on Apple, do you? Magsafe adapters were not "Apple inventions", either...
Not to be an Apple bashing thread, but it would not surprise me one bit if Disney did, lol. I mean, Pepsi did try to copyright their color blue so nobody could ever use that color blue without having the rights to do so.. they tried.
