How can president in the 5th circuit have any effect on the 9th circuit's ruling. I thought this is what people were talking about in February after Scalia died. That there would different laws in different parts of the country if the SCOTUS was split.

but is there a case somewhere in the 9th Circuit on this issue? If there are no pending DACA/DAPA cases in any of the district courts in the 9th Circuit, it can't go up to the COurt of Appeals.

It would be great if a Circuit did issue a different decision. It would mean a conflict among the circuits and the matter would go back up to the Supremes.
