Reinstate The Combat Assault Weapons Ban Now...Gov. Martin O’Malley

06/23/2016 08:33 am ET
Gov. Martin O’Malley
Former Governor of Maryland and Mayor of Baltimore

The U.S. Military Academy’s director of terrorism studies notes that U.S. terrorists have turned to guns, because explosives and explosive materials are monitored more attentively by the government than gun sales.

American al-Qaeda operative Adam Gadahn emphasized this troubling reality in a video to American jihadists, telling them a fully automatic assault weapon could be purchased at a gun show without a background check or ID card.

His chilling question to them: “What are you waiting for?”

"American al-Qaeda operative Adam Gadahn emphasized this troubling reality in a video to American jihadists, telling them a fully automatic assault weapon could be purchased at a gun show without a background check or ID card."

But buying a fully automatic rifle is already subject to background check and ID requirements (not to mention the permit from the federal government it would require). If someone at a gun show sells one of those without a background check and permit, they are already breaking the law. I suspect the guy is actually talking about buying a semi-automatic weapon.

dollars and about six months time to purchase a combat assault rifle which is an NFA item and very heavily regulated.

Some states don't allow ownership at all.

Almost zero have ever been used in any crime, ever.

O'Malley doesn't know what he's talking about.

6. What Makes the AR-15 So Appealing to Mass Shooters?

by Meghan O'Dea JUNE 13, 2016, 8:00 AM EDT

What do James Holmes, Adam Lanza, and Omar Mateen have in common? Besides being the perpetrators of three of the deadliest mass shootings in U.S. history, they all share a preference for the AR-15 assault rifle.

The AR-15 assault rifle was used at the Aurora, Colo. shooting, the Newtown, Conn. shooting, and now the mass shooting in Orlando, Fla. that killed 50 and is officially the deadliest such massacre in U.S. history. Quartz reported that an illegally modified version of the rifle was also used in the San Bernardino attacks.

So why is the AR-15 so appealing to mass shooters?

ARs are used in very few mass shootings. Most mass shootings are committed with semi-auto handguns.

Connecticut had an AWB in place before the Sandy Hook massacre and Lanza's rifle was compliant. AWBs will not stop massacres.

When it comes to reducing gun violence in America, our leaders are playing a deadly game of small ball. And everyday Americans are losing badly.

This year alone, including Orlando, more than 6,200 Americans have lost their lives due to gun violence. It is a staggering toll as we near the half way mark for 2016. An incalculable loss for every family and community struck.

And yet, the United States Congress is fighting to debate and vote on only the most incremental reforms to reduce gun violence.

Yes, its true that many American's are dying from gun violence. Most of them are suicides and virtually none of the proposed gun laws on the federal level would address them at all. When attempts to include the mentally ill who are dangerous to themselves or others in NICS are made, there is usually a push back from segments of the right and left based on patient privacy and dignity. Where do you, MOM, stand on developing a mechanism with due process for including the mentally ill who are dangerous in NICS?

While enhanced background checks, closing gun show loopholes, and imposing “no fly - no buy” provisions are important, these steps represent a fraction of what we must do as a society to curb gun violence in our communities.

First and foremost, we must stop allowing ISIS-inspired “lone wolves” to buy combat assault weapons so easily here at home.

Combat assault weapons" is a new term of art. I'd like to hear how you define that term.

In 1994, Congress passed an assault weapons ban that limited high capacity magazines to 10 bullets or less. The ban on combat assault weapons also made it illegal to manufacture any semiautomatic rifle with a pistol grip and a bayonet mount, preventing certain models of new AR-15s and AK-47s from entering the marketplace.

Mass shootings decreased when the assault weapons ban became law, but Congress — under pressure from the NRA — allowed the ban to expire in 2004.

That's interesting. I have not seen any report based on data that said the 1994 Federal Ban had any impact on gun violence. I'm sure you have the citation for such a report handy. Let me know.

In 2013, following the horrific massacre of innocent school kids at Sandy Hook, we banned the sale of combat assault weapons in Maryland. It took principled and persistent leadership to assemble a coalition of the reasonable. But we did it as a State and that’s exactly what we must do as a nation today.

Ok, but did you know the state of Connnecticut had an AWB in place (modeled after the expired 1994 Federal AWB) and Lanza's rifle was compliant? In what way did the AWB help mitigate the carnage at Sandy Hook? Why do you think another AWB would make any difference?

While reasonable Americans in both parties support “no-fly, no buy”, the NRA has once again used their influences over our Congress to block even this smallest of steps. The law of our land remains no law in our land when it comes to combat assault weapons sales. No enhanced background checks, no fingerprint licensing provision for handgun purchasers, no assault weapons ban, no limit on magazine capacity.

It is time for Congress to listen to the vast majority of Americans instead of taking its orders from gun manufacturers and the National Rifle Association.

Well, I could see this claim having merit if it were only Republicans who voted down the "No fly, no buy" legislation, but as it turns out a majority of Democrats also voted down the Cronin amendment which would have included the 'no fly' list in NICS, but had a due process mechanism included. Why did Democrats vote down this legislation? Was it because of the due process mechanism? If so, why is due process a problem?

Our own failure to enact reasonable gun violence prevention laws is now being used against Americans by ISIS-inspired lone wolves.

We should be so lucky to have actual terrorist go to gun shows looking for fully automatic assault weapon without a background check or ID card" because they will never find them. They do not exist.

The same question might be asked of us — what are we waiting for? How long will we sit idly by and allow terrorists and psychopaths to use our inaction against us?

The evidence at this point is overwhelming. Whatever the various motives, the carnage in cities and neighborhoods across America cannot be denied. The fact that ISIS inspired lone wolves are now using our failure to act to kill American citizens on American soil can no longer be ignored.

We must reinstate the combat assault weapons ban and we must limit magazine capacities to 10 rounds or less. American lives are at stake.

Again, the Sandy Hook massacre happened with an AWB compliant AR. Why would you propose laws that claim to address this kind of horrible act when they won't?

But domestic terrorists get the last laugh once they realize that, due to a fundamental design flaw in these defective consumer products, semi-automatics will spew out bullets as fast as a domestic terrorist can twitch their itchy trigger fingers.

So 100+ year old technology is, in your mind, fundamentally flawed? Semi-automatic handguns existed prior to the year 1900 and semi-automatic rifles and shotguns existed prior to WWI.

So a hundred years later YOU decide that all of those guns are fundamentally flawed.

The only point that you are making here, is that the design defects of these consumer products may be the result of maliciousness, rather than mere neglect, given how long manufacturers have had to improve the design.
