WASHINGTON -- The Supreme Court has refused to hear an appeal challenging President Barack Obama's U.S. citizenship and his eligibility to serve as commander in chief.
Without comment, the high court on Monday refused to hear an appeal from Alan Keyes, Wiley Drake and Markham Robinson.
The 9th U.S. Circuit Court of Appeals ruled the challengers did not have legal standing to file the lawsuit.
The U.S. Constitution says only "a natural born citizen" may serve as president. The challengers allege that Obama, whose father was Kenyan, was born in that African country, rather than in Hawaii. They claim his Hawaii birth certificate is a forgery. Hawaii officials have repeatedly verified Obama's citizenship.
Keyes and Drake ran against Obama on the American Independent Party ticket and Robinson serves as the party's chairman.

(693 posts)are pretty big requirements for a federal case to be decided. Can't bypass them because the court would like to get to merits to case.
I would love for this issue to be decided on the facts by the supreme court at some point just out of pure interest.

(550 posts)The right are still trying to make their own version of the Bush/Gore controversy, and while we've been saying that Bush didn't even win the election (he didn't win), they've been trying to invalidate the Democratic President's term. And the fact that he's not white is probably particularly galling.
Thing is, just because he's of African descent doesn't mean he's FROM AFRICA. While some of the birther arguments are rather compelling, the fact remains that he's an American born citizen. The interpretation of Natural-Born is really ridiculous, and I wish the SCOTUS would actually hear it to put it to freaking sleep forever. I'm in the same EXACT situation as the President. My father came from Egypt, and my mother is as white American as a slice of Kraft cheese. I'm an American citizen, I was born and raise in Brooklyn. If my father or President Obama's father came from, say, France and happened to be white men, would the GOP have such a huge freaking problem?

And Keyes is a theocratic religious nut, who is fond of spouting off the most asinine remarks.
Wiley Drake is a preacher, who regularly prays for God to kill people he doesn't like.
Including Barry Lynn from Americans United for the Separation Of Church and State, and President Obama.
