(70,671 posts)* What does it take for a Referral - can ONE p.o.s.CongressCritter (CHAFFETZ) make the Referral on his own authority?
* Does the Referral come from the Committee where the testimony was given? By a majority of the Committee? The whole Committee?
* Does it come from a vote of the whole House?
It would seem that if a Referral can happen as easily as this, NOBODY would agree to testify about ANYTHING. Oh, then it would be Contempt of Congress!1

Clinton unlikely to face perjury charges in email scandal
By Sarah Wheaton
.... It will be a shark with no teeth, said Rusty Hardin, the lawyer who successfully defended the pitcher Roger Clemens when he was charged with lying to Congress about doping in 2010. Perjury is a very, very difficult crime to prosecute. ....
They get referrals all the time, said Hardin, reached as he watched the Comey testimony on television from his vacation in Florida. Every time a congressman gets bent out of shape about something, they try to refer it.
The House Oversight Committee has also sought investigations, for example, into Lois Lerner over her testimony about the IRSs alleged targeting of conservative nonprofits. ....
The Clemens referral went to the Justice Department in February 2008, Hardin recalled, and the indictment didnt come until August of 2010. ....

(15,429 posts)That's the only reason the assholes did it. They know damned well and good there were no lies, so they are referring it any way so they can say, "Hillary Clinton is under investigation by the FBI!"
What they hope is the investigation keeps going throughout the entire election season. What I bet happens is it comes back with no findings of criminal activity before the end of summer.

(11,761 posts)I think that was what this whole 'hearing', was about today- laying the foundation. They are going to continue with their bullshit kangaroo court antics for as long as they can get away with it. They've been pulling this shit forever, I'm so sick of it. I can't even look at their smarmy smirky faces without feeling complete disdain.
