The man who was instrumental to making the first released recording of the Alton Sterling shooting go viral was arrested less than 24 hours later on charges of assault and battery, a move that he says was an act of police retaliation, according to a report by Carlos Miller with Photography Is Not a Crime (PINAC).
Alton Sterlings death was still only a local controversy before Chris LeDay shared the video of the killing to his roughly 13,000 Instagram followers, 6,00o Twitter followers, and 2,000 Facebook friends. The video was then shared thousands of times, including by New York Daily News writer and Black Lives Matter supporter Shaun King, who shared it less than an hour after LeDays post.
I wanted everybody to see this video, LeDay told PINAC. I wanted it to go viral. The police were already saying their body cams fell off and I wanted to show there was video of the shooting.
The very next day, while trying to get through a security checkpoint to go to his job as an aerospace ground equipment technician at Dobbins Air Reserve Base, LeDay was surrounded and detained by ten military police officers, some of whom carried M-16 rifles.

(12,482 posts)Any problems in PDs as a whole in this country are assuradely much worse in LA. They are corrupt on a Mexican level (I lived in Mexico for years and still have family there so that isn't some ramdom comment.) If you want to see cops getting drunk in public and in uniform, go to NO. Shit NOPD would once rent you a cop as a hit man, for not much money either.

The highest ranking officers in the King City Police Department for years targeted the city's most vulnerable residents, essentially stealing their cars for profit, District Attorney Dean Flippo said Tuesday.

(22,165 posts)LeDay thinks that police chose to make a spectacle of arresting him at his workplace because someone in law enforcement was trying to get him fired in retaliation for posting the Alton Sterling video. An assault and battery arrest would have been immediate grounds for his dismissal. Fortunately, his boss laughed it off when he learned it was about unpaid traffic tickets.

The man who made the video of the Alton Sterling shooting death go viral, one of two brutal videos from two states that sparked a national outrage and led to the shooting deaths of five Dallas police officers during an anti-police brutality protest Thursday was arrested 24 hours later.
Chris LeDay believes it was an act of retaliation.
Considering police handcuffed and leg-shackled him after accusing him of assault and battery only to jail him overnight for unpaid traffic fines it certainly appears that way.
Especially considering his arrest took place 24 hours after he had posted the video on Facebook, Twitter and Instagram where it instantly went viral.

(7,290 posts)that he was wanted for assault and battery, then I understand their response. And if they were told that, then I agree that he might have a defamation claim against the police department.
But the act of arresting him and keeping him in jail until he paid his traffic fines isn't a violation of his civil rights. I applaud him for posting the video and getting the word out about really happened, but with that comes the risk of being found, if there are outstanding warrants.
I'm sure it took all of two minutes for the police to see his name attached to the video, run his name through the system, and then track him down.

(7,016 posts)who has a unfair harassment problem . Could have blew out a call or letter letting him know he has a warrant for unpaid fines and follow-up later. I don't know maybe they did. Will see.

(7,290 posts)But he says he knew that he owed the fines, so there may have been existing warrants.

He wasn't arrested for assault and battery.

(90,335 posts)... any other charges at the time.
The law here is pretty clear, if they give him the impression he's in jail for one charge even if they change it later its that charge they DETAIN him for (meaning they give him the impression he can't leave) then he's under arrest FOR THOSE charges.

(7,290 posts)The military police detained him at the request of the local authorities. He wasn't jailed at the base, and he wasn't arrested. Military police don't have the authority to arrest someone on a civilian warrant - all they can do is detain the person(s) until the appropriate authorities show up to take them away.
Now, where he very well may have a claim against DeKalb county is that they apparently told the military police that he was wanted for assault and battery. There was no need to do that, since the military police would have detained him on any arrest warrant at the request of the local authorities. By telling them it was assault and battery, they guaranteed that he would be treated much worse (leg shackles, etc.) than he would have been had they told the truth about it simply being for traffic fines.

SickOfTheOnePct
(7,290 posts)But military bases do normally have reciprocal agreements with local law enforcement to detain anyone wanted on a civilian warrant once they are notified.

Seriously-This happened to me...
I metal detect & I found a early pioneer grave on county property. I had already found the county dumping human remains in a pile by the side of the road-a mistake I was told & it was eventually cleaned up.
The county got tired of me I guess & decided to have the local police take the "evidence" of the remains I had gathered. They were on a riverbank & erosion had them washing away so I wanted to save them. In hindsight I'll just re-bury them next time.
Because after I did my civic duty & turned them in etc...I got a call from the Captain & he treated me as if I was some sort of grave robber. I tried telling him my utmost respect is what led me to save the bones.
I detect for health reasons-I have a serious sleep disorder & old broken bones/ arthritis. I am on disability as I have a lot of problems from chronic lack of sleep-the detecting gives me exercise & really helps mobility.
2 weeks later I get certified mail I'm getting a disability review. Took 8 months to clear & they claim they lost my paperwork etc...They put me hard through the wringer. Lucky for me I had solid proof of my disability. It could have cost me my house & broken my family.
And my bet it was the Policeman I talked to who called them. Just to F%ck with me for causing them a bit of work.
