Ammon Bundy's lawyers file motion for a mistrial - #BundyTeaParty

Ammon Bundy's lawyers have filed a motion for a mistrial, claiming Harney County Sheriff Dave Ward offered prejudicial testimony in court this week that the judge failed to address sufficiently.

Bundy's lawyer Marcus Mumford had asked Ward during his cross-examination Wednesday if he had conducted his own investigation into the 2014 armed standoff that occurred near Bunkerville, Nevada with federal officers attempting to corral Nevada rancher Cliven Bundy's ranch cattle. Cliven Bundy is Ammon Bundy's father.

Ward explained that what he learned about the Nevada standoff "scared the hell'' out of him. The sheriff went on to note that he had discovered during a Google search on the Internet that "some unstable people who had left that situation'' killed two police officers while they were eating lunch in a restaurant.

In court, Mumford asked the judge to strike Ward's comments, arguing they were unresponsive. The judge denied his motion ...

... he testified that he was never personally threatened by Ammon Bundy, nor did he fear for his own life, but he did worry about his community, reported Oregon Public Broadcasting.

"The threat I perceived was that they would bring people to town and try to overpower or overthrow my authority as sheriff," Ward tesitified.

Ward said what he had read about an earlier standoff with federal agents in Nevada by the Bundy brothers and their father, Cliven, in 2014, again over pasture rights, frightened him. "The thought of that happening in my community scared the hell out of me," he testified.

The prosecution presented emails from defendant Neil Wampler to Ward. They included one that said if the sheriff did not support other protesting ranchers facing jail for setting fires on federal land the area would be "invaded by some of the most determined and organised – and armed – citizens alive in this country today." Another of the emails, sent in 2015, simply warned: "We ain't playin'" ...

... Harney County Sheriff Dave Ward said the Bundy-led protest at the refuge was "absolutely not a peaceful occupation." Ward described it as an armed clearing of a room that included military-style tactics.

Bundy's attorney, Marcus Mumford, asked the sheriff about a cordial meeting he had with Bundy a few days into the occupation. In a clip of the meeting, Ward offered Bundy safe passage out of Oregon while praising the leader for getting his message out to the world.

Ward said he wasn't there to pick a fight. He just wanted them to leave ...

good on our justice system to put them away for the rest of their worthless lives.

Ward was away at a sheriff’s conference.

According to Needham’s testimony, Payne described his philosophy on how the federal government can’t own land and said that Sheriff Ward was not being a Constitutional sheriff. He told Needham that he needed to get rid of Sheriff Ward using any means possible, including death ...

Ward answered your foolish question, you didn't like the answer he gave, the judge denied your motion to strike, it was your own mistake that Ward's testimony is now part of the record. Sorry, but the rules of procedure and evidence aren't constituted to save you from your own stupidity.

Maybe the Bundy Radical Terrorists should have hired a better lawyer?

the defense will almost always file for dismissal or change of venue.

The filing is kind of meaningless in and of itself. The ruling will matter, of course.

His remarks, though, were about a man and a woman accused of ambushing and fatally shooting two police officers at a Las Vegas restaurant in June 2014. According to news reports, neighbors had said the couple, who later died in a murder-suicide, had previously boasted about spending time at Cliven Bundy's ranch and had talked about being in Bunkerville during the April 2014 standoff ...
