Supreme Court tied 4 to 4 nowdays.
Who becomes President?
Lived through Bush v Gore mess.
Don't ever want to see that again.
Al gave in for the good of the country.
It was the wrong move.
Should have fought harder.
HRC won't back down if it comes to this scary scenario, just don't want to go there again.

(52,110 posts)they only intervene where there's a legal dispute, as was the case with the various recount efforts in bush v. gore.
of course, their decisions that somehow there's justice in simply halting the recount at an arbitrary moment when shrub was ahead was absolutely ridiculous by any reasonble measure....
in any event, if anyone fails to get a majority of electors, the (newly elected) house decides who is president, and the (newly elected) senate decide who is vice-president. in practice that means trump wins a tie. it might be interesting if we win the senate (unlikely if hillary isn't winning the general), in which case we could have kaine as vice-president. that would be a disaster, though, as it means the republican house would never impeach trump, no matter what, unless kaine agreed to resign first.
but, yeah, if there's an actual legal dispute, they could deadlock 4-4, in which case the lower court ruling(s) would stand. on the other hand, staying out of it might be the wiser thing anyway.

(88 posts)Never recognize GWB as,the elected leader of America. It wouldnt have changed the outcome in 2000 but in 2004 it would have made a difference.
A pure act of defiance that would have rallied the base sooner.
The first protest vote for 2004.

(17,367 posts)Individual congressmen do not get a voter. This would tend to favor Republicans, assuming votes are cast along partisan lines.

Obviously, anything is possible, but I think flipping the house is a longer shot than a Clinton victory.

(19,816 posts)Apparently the house can choose any of the 3 top vote getting candidates even if he top 2 are tied so it might be 'hello to president Johnson.'

The top 3 vote getters applies to the electoral college, not the popular vote.
