(And, yes, that really is what it looks like. That would tick me off, too.)
I remember lots of discussion about EP under *, Clinton, Bush I, and I think I remember EP being invoked more than a couple of times, but not at the formal public request of the person subpoenaed.
Private requests, perhaps they're frequent.
