(3,463 posts)And they did not do it at the start of this session so they'd have to wait for the first day of the session after the 2018 elections to change it. I could be wrong, but I believe that is the only time they can change the fillibuster rules.

(26,727 posts)The claim was that the filibuster rule could only be changed at the start of a session. That isn't correct. They can do away with it for SCOTUS appointments any time they can get 50 of their senators to agree to do it.
My guess is that Democrats recognize that we can't win this fight (absent something scandalous for a particular nominee) and will make noises to satisfy the base, but will eventually get a handful of Democrats (likely the ones up for election in red states next year) to bring the number to 60 so that undoing the filibuster isn't necessary.
The old-style filibuster is still available (stand up and speak)... so we may get someone willing to do that to gain attention.

(4,460 posts)When he was AG here, he played a big role in getting sex toys banned in the state. He argued there was no such thing as privacy in sexual matters. And of course, the purity and goodness of Alabama women needed to be protected. He would be like Scalia on steroids.
