Normally, when the Fed gov't is sued, the AJ and Justice set up the defense team...

Not sure I understand the use of the word defend, here.
Could it just mean "keep out of it?" Not on the cnn website, yet.

Meanwhile, this gives the Dems more incentive to drag their feet on Sessions.

The Judge will hear the case, but there will be no attempt by the Justice Dept to defend against the suit. So 'keep out of it'.
