The claim survived a motion to dismiss.

To do that you have to identify a legal theory and make up facts that match the legal theory. (Now, any attorney who actually does make up facts would be in deep doo-doo, but it would still survive a motion to dismiss - in which the facts alleged have to be taken as true.)

Generally, parties only lose motions to dismiss when the attorney was incompetent in drafting the claim (or in some other aspect - such as not checking the statute of limitations). It is the lowest of bars and says nothing about the ultimate validity of the claim (or the judges opinion of the merits fo the case).
