Let's face it, he thought he could simply executive order his way to tyranny, only to get beaten down in the courts. He's learned to occasionally accept the advice of those who know how to achieve the result more slowly, but more surely.

And eventually, everything ends up in the Supreme Court, which just got the tie-breaking vote for the wrong side.
