Under FISA, when the government seeks to conduct certain types of surveillance on U.S. soil, it is generally required to apply for and obtain an individualized order from a judge on the FISA Court. If an American is the target of the surveillance, that application must be reviewed and approved by the attorney general before it goes to the FISA Court."
The District of Columbia has a one-party consent law. Comey could have recorded the conversation, legally, without Twitler's knowledge.

(6,324 posts)Laws in states call for either single party consent, where only one person party to the conversation must be aware of recording to double/all party consent where all parties involved must be made aware of the recording.
Federal law and the law in DC is single party consent.
