Patribotics' (Louise Mensch) Latest Post Asserts FBI Changing Positions On FOIA Requests

Patribotics' (Louise Mensch) says in its (her) latest post that the FBI has written to her lawyers that the FBI will no longer rely on the notorious GLOMAR response to her and the James Madison's Project's FOIA requests concerning the "information leaked to Rudy Giuliani" during the campaign concerning the FBI's investigation concerning HRC emails. As Mensch make's clear this doesn't necessarily imply the provision of any documents by the FBI under these FOIA requests, but it does mean, she says, that "The FBI is, therefore, about to send us [her lawyers] a response which won’t say 'we can neither confirm nor deny' this."

She also asserts that an amended FBI response to another FOIA request relating to Trump's campaign plea to "Russia, if you're listening . . ." to release the alleged 30 thousand Clinton E mails. She argues that "This [changed response] does appear to confirm there is an active investigation into Donald Trump’s request to Russia to release Hillary Clinton’s emails."

What all this means is anybody's guess.

In United States law, the term Glomar response (aka Glomarization or Glomar denial) refers to a "neither confirm nor deny" (NCND) response to a Freedom of Information Act (FOIA) request. There are two types of instances in which a Glomarization has been used.
