President Obama was available until 1/22/17...Comey already began to feel uncomfortable with meeting tRump pre Inauguration.... Obama already tossed the Russians out of the NY compound and issued sanctions to Putin/ Russia...Flynn was already in deep shit too so a Presidential FISA could of been obtained and ready...

Also...Washing D C has the "one person" conscent rule...so, it could work...

Think about it, your safety could be at issue if you have someone threatening you and you may need to prove comments were made. It is legal as long as 1 person knows about it.

It would be illegal to leave a recording device in a room after you left it.

I can't find it now, but I remember hearing during one of his phone conversations he may have had other people with the FBI in the room during it. If true that could be a big deal.
