After marveling at the lede of this new Washington Post bombshell Mueller investigating Trump for obstruction of justice I went back and read the whole piece again. You would think that news would be enough for a single piece. But when you read it all the way through the picture it paints is actually considerably more dire.
One key point is that Mueller did not start this obstruction investigation. According to the Post, that probe began days after Comey was fired on May 9
Mueller was appointed on May 17th. Reading the Post piece closely, I do not think it explicitly says that the probe began prior to the 17th. But the wording and logic of the piece strongly suggests that is the case.
One key point I draw from this is that it was clear to people at the DOJ and FBI almost from the beginning that this was a potential case of obstruction of justice. That makes me consider who then was in place to make such a decision. Once James Comey was fired, the acting Director of the FBI was Andrew McCabe, who remains in that role. If my surmise about the chronology is correct, Deputy Attorney General Rosenstein remained in charge of the Russia probe. Thus I think he would have been acting in Attorney General Sessions stead to make the decision to authorize such a probe.
This last point isnt crystal clear to me since this would not necessarily have been considered part of the Russia investigation. In any case, you do not begin such an investigation of a sitting President except at the very highest level. That decision apparently came quickly. We can note here that soon after Comeys firing Deputy Attorney General Rosenstein made statements suggesting that he may have been a witness to something that could be construed as a crime. If my memory serves, McCabe did as well. They are the two logical people to have signed off on an investigation at that point.

(16,858 posts)If you look at who Meuller has brought onboard to assist in the investigation and their areas of expertise, Marshall's theory makes a helluva lot of sense. This could get even more interesting.

I think the real question is going to come down to whether the DoJ, courts, etc. change the common-yet-never-tested assumption that a sitting president can't face criminal charges while in office. If that is upheld, the only immediate remedy is impeachment. Since the Republicans will never go along with that, no matter how damning the evidence, Trump is likely to remain in power, and can use his pardon-issuing authority to make sure any other charges are rendered moot as welll. OTOH, if it is now ruled that President Trump may have to spend his term "in the dock," it may change a lot...

and gives an example of how for Trump, suspicious financial activity is Business As Usual - citing the self-dealing by the Trump Foundation that David Fahrenthold uncovered, just as a journalist. A formal investigation can get a hell of a lot more financial records.

Remember how Patrick Fitzgerald was going to sink the entire Bush Administration for burning a CIA agent and exposing all the NOCs within the nuclear weapons proliferation team? That's how this is going to go.

(1,007 posts)that would leave him so exposed without first seeking outside council. When he was asked to produce the document...he had to have went outside the WH and discussed with other high people (Comey did when he felt uncomfortable with Dump's requests).
Maybe their advice was to let it play out...and then take Dump down. Just a thought!

(37,648 posts)Remember when Trump tweeted "I'm being investigated for firing Comey by the one who told me to fire Comey!" To me, that meant Rosenstein. Not much was talked about that tweet at the time, but I didn't understand it, because as far as I'd heard, there was no investigation of Trump by Rosenstein.
Maybe Trump was referring to the Russia investigation, but the Russia investigation is not an investigation of Trump, and it's not for firing Comey.
So Trump must have learned that Rosenstein was investigating him for obstruction? This was news to me, then I forgot about it. Until now.
ALSO...I was wondering about how fast Rosenstein decided WHO to appoint as Special Counsel. It was just days after Comey was fired. Then it was announced that Mueller would leave his firm and bring 2 associates with him, etc. All that leads me to think that there must have been discussions with Mueller going on for some time.
So I'm wondering if Rosenstein got busy on this the moment he was directed to write a memo giving reasons to fire Comey. But then, why did Rosenstein do a memo that crucifies Comey and implies he should be fired?
Is this Rosenstein trying to do whatever it takes to keep his own job? Or a dedictated Deputy AG trying to do the right thing? In any case, the Special Counsel is investigating Trump for obstruction because of the Flynn statements to Comey and other things.
