2. What makes it "Unconstitutional"?

Re-entry after deportation was already a felony "on the books"... this raises the penalties- but it has passed Supreme Court review.

I'm definitely not saying it's "right"- but even an atrocity like "Korematsu v US" is still valid precedent...
