Politically at this more advisory level of Executive Staff, he can follow orders and cover his ass under policies and regulations; they tend not to be as stringent at a staff level than they do when he's actually in the Military - or if he were part of the Department of Homeland Security, where he would be subject to the ethics regulations that the head of an agency would be under.
