Mitt Romney losing the Bain battle, ctd.



Until today, Washington Post fact-checker Glenn Kessler has generally applied a simple rule in evaluating the accuracy of attacks on Mitt Romney's record at Bain: If the alleged activities took place after February of 1999, the attack was false. Why? Because Mitt Romney said that he had retired from Bain in February of 1999 and if he no longer worked for Bain, then he couldn't be held responsible for its actions.
Over the past few weeks, however, reporting from Mother Jones, TPM, Boston Globe, and Daily Kos have undermined Romney's claim to have had nothing to do with Bain Capital after February, 11 1999. And now Kessler has reassessed:

Going forward, unless new evidence emerges, on a case-by-case basis we may withhold the awarding of Pinocchios when the claim rests mostly on the question of when Romney stopped managing Bain Capital.

Moreover, reports Kessler, neither Romney nor Bain are providing sufficient evidence to counter the evidence undercutting his retirement claim:

Romney has failed to provide sufficient evidence that he had “no role whatsoever” at Bain. Over the past few days, we have repeatedly asked Bain Capital whether the firm could provide a statement that a review of Bain board meetings had shown that Romney did not attend any such meeting, either in person or by phone. We are still waiting for a response.

With Kessler reporting that Bain won't provide evidence of Romney's lack of involvement in board meetings, it appears that Romney's last line of defense is crumbling. Politics is moving in slow motion today, but in the coming weeks, this shift will be a big deal.

Romney can't shirk responsibility for Bain

Romney contends that he ceased actively managing Bain in February 1999 when he joined the Olympics organization. As a candidate for president, he filed a Public Financial Disclosure Report with the federal Government Ethics Office stating that "Mr. Romney retired from Bain Capital on February 11, 1999, to head the Salt Lake Organizing Committee. Since February 11, 1999, Mr. Romney has not had any active role with any Bain Capital entity and has not been involved in the operations of any Bain Capital entity in any way."

As we learned last week, documents filed with the Securities and Exchange Commission contradict this statement.

Some of these documents were Schedule 13D reports, required to be filed pursuant to the Williams Act whenever any person or group acquires 5% or more of the stock of any public company. The purpose of such reports is to notify the securities markets of a possible change in control of a public company.

The contradictory representations in the Government Ethics Office and SEC filings are at best evasive and at worst a violation of federal law. A federal statute -- 18 U.S.C. § 1001 -- provides that anyone who "in any matter within the jurisdiction of the executive, legislative, or judicial branch of the Government of the United States, knowingly and willfully -- (1) falsifies, conceals, or covers up by any trick, scheme, or device a material fact; (2) makes any materially false, fictitious, or fraudulent statement or representation" shall be fined or imprisoned. Violations of federal securities laws, including the making of false statements in a 13D filing, are independently punishable under the securities laws.

How the fuck Romney is even in the race is beyond rational comprehension. The skidmark made his money selling out Americans, putting us out of work and stealing our pensions. Who would want him as president?

He thinks taxes are for the little people, his great granddaddy left the US because he didn't respect US law, Romney wants to fix the US alright. He, along with his contributors, want to turn us into a fiefdom.

He is so non-charismatic that he wouldn't even be voted for king of fools. So why is he even in the running? Big money is behind him, and the RW commandeered the religious contingent, all I can say is that there are some people who are going to be very surprised when even their rights are taken away.

He bullied and assaulted a gay classmate, and got away with it. Romney was the son of the governor, the bullied/assaulted kid was not.

During the height of the Vietnam War draft, Romney conveniently spent more than two years in France as a Mormon missionary.

While there, he drove the wrong way on a small-town road and caused a head-on collision that killed one person in his car. He lied that a "drunk priest" (Bishop Jean Vilnet, who was not drunk but was seriously injured by the negligent Mormon draft evader) caused the fatal accident.

The police-impersonator story is either another harmless young Mitt prank, or a sign that Romney likes to dominate and humiliate people, even his own family, on vacation at his NH lakefront estate.

...they'd certainly argue that, but lying to the SEC is still illegal. He's got a lot of explaining to do.
