Scoop: Mueller obtains "tens of thousands” of Trump transition emails

Special Counsel Robert Mueller has obtained “many tens of thousands” of Trump transition emails, including sensitive emails of Jared Kushner, transition team sources tell Axios.

*Trump officials discovered Mueller had the emails when his prosecutors used them as the basis for questions to witnesses, the sources said.
*The emails include 12 accounts, one of which contains about 7,000 emails, the sources said.
*The accounts include the team's political leadership and the foreign-policy team, the sources said.

Why it matters: The transition emails are said to include sensitive exchanges on matters that include potential appointments, gossip about the views of particular senators involved in the confirmation process, speculation about vulnerabilities of Trump nominees, strategizing about press statements, and policy planning on everything from war to taxes.

*“Mueller is using the emails to confirm things, and get new leads,” a transition source told me.

How it happened: The sources say Mueller obtained the emails from the General Services Administration, the government agency that hosted the transition email system, which had addresses ending in “ptt.gov,” for Presidential Transition Team.

Axios has asked the Special Counsel’s Office for comment and will update this story with the response.

*The transition sources said they were surprised about the emails because they have been in touch with Mueller’s team and have cooperated.
*“They ask us to waive NDAs [nondisclosure agreements] and things like that,” a second source said. “We have never said ‘no’ to anything.”

The twist: The sources say that transition officials assumed that Mueller would come calling, and had sifted through the emails and separated the ones they considered privileged. But the sources said that was for naught, since Mueller has the complete cache from the dozen accounts.

There is NO privilege when using an official government server. ALL information sent through a .gov address is the property of the government. Boy, I hope they tried to hide something really good. They don't even seem to know how to obstruct justice correctly.

Jared, knowing he would get a pardon for the contempt, would be emboldened to stonewall. He kind of has no other choice. But his stonewalling can only last so long, especially with indictments coming from various states.

It doesn't matter. They all know they are caught. Their only hope is that the truth is not believed, and that their most rabid devotees will cause civil unrest and assorted acts of violence.

So it is the Trump officials that have been talking to Axios, probably on background for other stories, and Axios was able to corroborate between the statements of several officials.

Thanks for posting it. It answers a lot of questions I had about obtaining that cache of emails in the first place. Mariotti points to a warrant. Mueller would have had to use a warrant.

Basically a govt agency asking another govt agency generally does not need a warrant. And apparently did not need one when asking for them from the GSA. Technically they are also not private emails when using the .gov account.

Taking fight public: Charging "unlawful conduct," Kory Langhofer, counsel for the transition team, wrote in a letter to congressional committees Saturday that "career staff at the General Services Administration ... have unlawfully produced [transition team] private materials, including privileged communications, to the Special Counsel's Office."

The seven-page later, obtained by Axios, says: "We understand that the Special Counsel's Office has subsequently made extensive use of the materials it obtained from the GSA, including materials that are susceptible to privilege claims."
The letter says this was a violation of Fourth Amendment protections against unreasonable search and seizure.
"Additionally, certain portions of the [transition] materials the Special Counsel's Office obtained from the GSA, including materials that are susceptible to privilege claims, have been leaked to the press by unknown persons."

The Special Counsel's office said: "We will decline to comment."

I doubt few if any were personal-lawyer-client discussions and if they were then the parties were utterly stupid to use government email addresses and servers.

It has to be with a private citizen with their own private property. Government emails are not the property of any private citizen.

are accessible to Mueller without any concern about privacy or 4th Amendment issues. They all are part of the official record and were automatically preserved and archived. The Trump team May not have known that. Amateurs.

Since Rosenstein told Congressional committee that there was no good cause to fire Mueller, Trump gang had to come up with something that they could assert as good cause, so they are ramping up phony outrage over this.

I just saw where trump is going to fire Mueller before Christmas. Actually he will have to tell Rosenstein to fire Mueller. Google Saturday Night Massacre to see how Nixon did it.
