Happening now: taking out a federal fence, post by post #bundymilitia #Oregonstandoff

That's all the evidence needed. Next question, were firearms used in the commisssion of these felonies? Yes, then the mandatory minimums kick in, each count, no exceptions.

UPDATE 5:30 PM local dark outside time. My question about firearms while committing the felony now answered.

Insurrection is when I RESIST that arrest with force.

Right now, sure we could call this property violations or some other such nonsense.
The real test will be when the Feds show up to enforce warrants.

(On edit) -- none of what I just said makes your Congressman any less of an idiot fuckwad. He should be smart enough to know how this could end (badly for everyone) and should be doing everything in his power to de-esclate this situation; if he's going to show up and run his mouth he should at least be trying to do something USEFUL with it...

AND there is the issue that several teabaggers in office have also been backing them as of the last 48 hours. Then there's that fence, one of the longtime issues for the guys who ARE in jail for tearing down that fence and setting fires etc.. This refuge is in dispute because the riparian vegetation and stream banks were being destroyed by cattle so the fence was erected to keep the cows out. The fence is the excuse for the insurrection.

And it isn't just a swamp, it is sensitive habitat that is being destroyed by these kkklowns and that heavy equipment. They want cattle to be allowed on the sanctuary at the very least... and a good old fashioned shoot out wif' de gubbamint. yahoo.

They are using the dozer they found, I'm guessing, and they sure as heck didn't walk out to the fence. Haven't seen the images yet but being slightly familiar with the place, they are indeed destroying sensitive habitat/land. It will take a lot of effort and time for the wetland in the area they are driving heavy machinery to recover from that. Just imagine you have a nice little wetland in your yard and some sh*tforbrainz comes along in a machine that weighs at least 30,000lbs and drives it over the wetland and then moves it around a whole bunch in a concentrated patch...

Yeah, cattle is a detriment to the landscape out in the west but the cattlefolks will tell you how they help improve the land and that they are actually good for the land, as one rancher berated me about last night. I even heard big Ed let a rancher tell him that rubbish the other day and he didn't challenge her. Remember, science is a ruse to them and what they think they know because gawd told 'em, is all that matters and has to be true if the voice in their head said so.

One of the unwanted side effects of the #BundyTeaParty, to their own interests, is exposure of the truth of land use out West, environmental destruction wherever not protected. This will result in higher grazing fees and more restrictions on environmental impacts. If we have any sense as a nation, it would result in habitat restoration wherever possible. But first, we have to throw the TeaParty out of Congress.

Tue Jan 12, 2016, 10:09 AM
Jan 2016

The not native cheat grass looks pretty and green in spring, it burns like crazy, its fire tinder in fall. All it takes is one asshole, one car/truck to drive off road or build a campfire- to ignite a wildfire.

I don't think most people realize sheep and cattle aren't 'clipper' grazers. Most people don't realize cattle do NOT even have upper front grazing teeth. just a flat skin pad up top to grasp and pull out grasses. Their manure doesn't spread seeds either.

Those livestock stay in one spot and eat roots and all, cattle wallow in springs and along creek & river sides until the land is dead sand. This causes erosion in lands so fragile the track damage from the 100 years ago wagon trains still are easy to see.

162. A majority of people in the West care deeply about the land.
Tue Jan 12, 2016, 11:59 AM
Jan 2016

Moreso perhaps when they own it themselves. Over-exploitation is counter-productive and ranchers know this.

The Nation is complicit for creating the situation. The West was won (read: stolen) with guns and raped for resources to the extent allowed. Now, there is a culture clash and the values that stole a continent for the Anglo nation; draw first, shoot to kill, the only good Indian is a dead Indian, there's gold in them thar hills and forests, etc., are obsolete. Cultural transformation takes time, moreso in once isolated communities. Today, a new generation is upon us, the fossils are really outnumbered, and in a connected world, rural insular culture is a thing of the past for the younger generation. The ecological wisdom of the Natives is no longer esoterica to ignorant immigrants, it is the majority view.

That does not change the nature or impact of "hooved locusts" though. We need to regulated the range better, for the benefit of the natural world and our future sustainability, not for personal profit of greedy locals. If the federal government continues to subsidize rural communities in sparsely populated areas, and there are very good reasons to do so including care of the public lands, there are far better ways to stimulate rural economies. How about infrastructure spending. But hey, the US's apparent need to militarize the globe prevails over concerns such as roads and bridges at home.

Wed Jan 13, 2016, 01:09 PM
Jan 2016

I say the fees for use of fed lands need to increase along with incentives to restore abused and overused areas. I have seen far too many abuses in the west and ranchers and miners get use of the land almost free. Witness the miners ' fees similar to 1800s fees and we no longer have pick and shovel miners but heavy equipment operations.

Stimulate rural economies by incentives like eco tourism, grass fed, pasture raised meat operations that are small farm oriented and organic grain growing. It is nearly impossible to get organic wheat, for example, and organic bread is sky high. But poisoning the land, running large herds, and heavy equipment mining rule.

Btw, organic farming nationwide is up to 1%of all farming. Whoopdedoo.

Nevada, Oregon State Reps Meet With Armed Occupiers
by John Sepulvado and Dave Blanchard OPB | Jan. 10, 2016 Burns, Oregon

Nevada state Rep. Michele Fiore, a Republican, tells OPB she called Ammon Bundy Saturday night. Fiore has long been an ally of the Bundy family. The representative sponsored land transfer legislation known as the ‘Bundy Bill’ in March last year, and directed profanity at another colleague on the floor of the Nevada legislature while defending it.

“Everyone knows I’m a supporter of the Bundy family,” Fiore said. “Our relationship is pretty well documented.” ..............

Letters asks U.S. Attorney General for response to refuge occupation

A pair of groups representing current and former federal employees have sent a letter to the head of the U.S. Department of Justice urging action to end the occupation of the Malheur National Wildlife Refuge headquarters.

“In our experience we have learned that lawbreakers must be held accountable in a timely manner or they will gain power and become more dangerous,” reads the letter from the Public Lands Foundation and the National Association of Forest Service Retirees sent Tuesday to U.S. Attorney General Loretta Lynch. “We are very concerned that the longer that no action is taken, the current situation will deteriorate and become more and more dangerous for the dedicated people protecting the public lands and the public legally using these lands.” ........

Criminal Trespass
The crime of criminal trespass involves a person knowingly entering or remaining on a property on which he knows he does not have permission to be. Criminal trespass is most often a misdemeanor, though it can be prosecuted as a felony, especially if the trespass results in damage to persons or property.

The jerks only had the "courage" to act this way because Bundy's father has
*never* been punished for his crimes.

Failing to respond to criminal action is tacit approval of it.
That's why aiding & abetting is a crime alongside the action being supported.

Unfortunately, the government agencies were proven - to the whole world - to be
aiding & abetting Bundy senior's criminal activity and this is the result.

Apparently, enforcing the law against white gun-owners has been vetoed in
favour of allowing them to do whatever they want for as long as they want to.

The Hammonds were charged with malicious destruction of federal property by fire.

The Antiterrorism and Effective Death Penalty Act of 1996, Pub. L. No. 104-132, 110 Stat. 1214, (also known as AEDPA) is an act of Congress signed into law on April 24, 1996. The bill was introduced by former Senate Majority Leader Bob Dole, passed with broad bipartisan support by Congress (91-8 in the United States Senate, 293-133 in the House of Representatives) following the 1990s World Trade Center and Oklahoma City bombings, and signed into law by President Bill Clinton.[1][2]

I sure hope they will be charged with pulling fences down. That is not consider a light offense in public ranges.

Legal Mandates relating to Public Lands Grazing

Laws that apply to the BLM’s management of public lands grazing include the Taylor Grazing Act of 1934, the National Environmental Policy Act of 1969, the Endangered Species Act of 1973, the Federal Land Policy and Management Act of 1976, and the Public Rangelands Improvement Act of 1978.

FEDS: USE, CARRY OR POSSESS A FIREARM IN RELATION TO OR IN FURTHERANCE OF ... FEDERAL CRIME OF VIOLENCE:
18 USC § 924(c). Punishment ranges from at least 5 years up to life imprisonment,
without parole, or death if death results from use of firearm. Sentence must be
served consecutive to any other sentence. Mandatory minimum sentence increases
depending upon: the type of firearm involved (sawed-off gun, silencer, etc.);
whether more than one offense was committed; and whether gun was simply
possessed or was brandished or discharged.

Oregon: ORS 161.610 Enhanced penalty for use of firearm during commission of felony
... if a defendant is convicted of a felony having as an element the defendants use or threatened use of a firearm during the commission of the crime, the court shall impose at least the minimum term of imprisonment ....

(4) The minimum terms of imprisonment for felonies having as an element the defendants use or threatened use of a firearm in the commission of the crime shall be as follows:

(a) Except as provided in subsection (5) of this section, upon the first conviction for such felony, five years, except that if the firearm is a machine gun, short-barreled rifle, short-barreled shotgun or is equipped with a firearms silencer, the term of imprisonment shall be 10 years.

.... felony crime of motor vehicle theft ... person must serve the full sentence and may not have the sentence reduced for any reason.

We don't have enough time left today to enumerate the possible statues that can be brought to bear. But, stealing a motorized vehicle in combination with the armed threat is a really long term for just that count. Each count must be served and cannot be reduced when firearms are involved in the commission of a felony seems to apply here.

Federal Agency Condemns Militants Removing Refuge Fences
by Conrad Wilson OPB Jan. 11, 2016

The U.S. Fish and Wildlife Service is condemning the removal of fences bordering the Malheur National Wildlife Refuge by militants occupying the public property.

In a video released late Sunday, Ammon Bundy claimed his group would visit nearby ranchers Monday.

“We’re planning on going down to the ranch adjacent here to the Malheur Refuge where they’ve cut off the largest portion of their range,” Bundy said in the video address. “We’re going to go take that fence down and get those ranchers back to ranching on their range.”

Uneven enforcement of the law could become a new rallying cry. Though, to be fair, if they eventually charge the crap out of these people, that might not be much of an issue.

These people might become the poster children for "What were they thinking?".

But on the third hand, we start getting into a grey area. It's like the case of a cop trailing a car and eventually handing out dozens of tickets for the many violations that were witnessed over the course of an hour. IIRC the courts take a dim view of that.

As I stated in another thread; Imo, a DOJ representative should issue a statement of the penalties involved with these kinds of offenses. Better yet, let a journalist ask about them, then answer.

Occupied Oregon wildlife refuge known for listening to ranchers
Updated January 11, 2016

Grievances of outside protesters don’t seem to fit Malheur National Wildlife Refuge, where local Oregon ranchers and federal managers spent years working out their differences and arriving at a collaborative “adaptive management” plan.

By Hal Bernton
Seattle Times staff reporter

DIAMOND, Ore. — On a winter day of steel-gray skies, some 450 head of cattle found welcome forage in a flat, boggy expanse of lowland acreage. There, they grazed on a buffet of blue joint, creeping wild rye and other grasses that were cut and piled in the fall and now help them survive during these lean winter months.

This field is part of the Malheur National Wildlife Refuge, which has a headquarters now occupied by armed anti-government protesters.

Over the past week, as the protesters raised a yellow “Don’t Tread on Me Flag,” they have portrayed the refuge as emblematic of federal tyranny in the rural West, and demanded the land be placed under local control.

For others, this remote refuge has become a very different sort of symbol, one that shows how federal agencies can reach out to different groups with different agendas — tribes, environmentalists and ranchers — and find common ground on how to manage the nation’s public lands.

The colonists, too, have historical pathways to get where they are today. Unlike Indians, they take pride in being ahistorical and always seem to think they’ve just invented some wheel that, to a historian, shows a lot of wear and tear. The Tea Party, for example, got its seed money from the same folks who seeded the John Birch Society, and so it’s no great surprise that the politics of the two organizations are similar.

As I write, an armed mob of “patriots” has occupied a bird sanctuary that occupies Northern Paiute land in Oregon. The Paiutes have no objection to a bird sanctuary, but the occupiers do. .....

Oregon judge plans to bill Ammon Bundy up to $70,000 a day for security costs to county

An Oregon judge says he will bill Ammon Bundy up to $70,000 a day to reimburse Harney County for security costs related to the ongoing occupation of a wildlife refuge.

Bundy said the militants had rifled through files at the occupied building looking for evidence of wrongdoing, but he insisted they had not accessed computers — although public radio reporters witnessed them doing that.

WATCH: Teen chokes up at town meeting asking Bundy to leave, says ‘I shouldn’t have to be scared in my own hometown’

Some of the Fish and Wildlife employees have been relocated from their homes “out of an abundance of caution” in case their personal information, including home addresses, had been accessed by the militants. .................

All Hat, No Cattle: Three Things to Know About the Militants’ Standoff in Southeast Oregon

The Bundy brothers came to Oregon saying they’d been led by God—and were soon followed to Harney County by a pack of local and national media.

.... Federal prosecutors built their case around three deer hunters, who testified that the Hammonds' hunting party shot into a group of seven or eight small bucks on federal land, constituting illegal poaching. "I saw at least four bucks get hit by bullets," testified hunting guide Gordon Choate. "I saw one with a leg flopping, running. And basically the herd of bucks just exploded like a flock of quail."

Prosecutors argued that by starting the fire, the Hammonds were able to destroy evidence of the deer slaughter. ..../

‘We Don’t Want Bloodshed’: Armed White Militants in Oregon v. Paiute Tribe
Jacqueline Keeler
1/12/16

Yet more armed, white militants, members of the Pacific Patriots Network arrived in Burns, Oregon this weekend. They claimed to be there to prevent another Ruby Ridge or Waco by providing a buffer between Ammon Bundy, son of Nevada rancher who drove BLM officers off his land with guns in 2014, and law enforcement.

Carrying guns, they presented a resolution to the FBI and local law enforcement calling for the return of land to the people of Harney County—and surprisingly, recommended co-management with the Burns Paiute Tribe.

Burns Paiute tribal chairperson Charlotte Roderique has stated to the media her irritation with Bundy and his “militia” supporters goal of “giving back the land to ranchers.” “It’s been validated we’ve been here since 15,000 years ago,” she told ICTMN. “These people are ignorant of the history and that they don’t think about the statements they are making. They are misinformed.”

The Northern Paiutes signed a treaty with the U.S. Government in 1868 that was not ratified and the land, including that of the Malheur Wildlife Refuge remains unceded tribal territory. ....

Roderique noted that “Secretary Jewell assured us that the federal authorities would take care of our sacred sites out there.” ....

Self-appointed 'judge' arrives in Burns to ask local residents to charge government officials with crimes
Oregonian/OregonLive By Betsy Hammond | The Oregonian/OregonLive January 12, 2016 at 5:55 PM

A self-proclaimed "U.S. Superior Court judge" who has been involved in past property rights protests in other states arrived Tuesday in Burns with plans to convene an extra-legal "citizens grand jury" that he said will review evidence that public officials may have committed crimes.

Bruce Doucette, a 54-year-old owner of a computer design and repair shop in suburban Denver, told The Oregonian/OregonLive, that he made the trip at the request of Harney County residents. He said he met with the armed occupiers of the Malheur National Wildlife Refuge to hear their evidence, which he called "significant," that government officials have committed crimes.

But he declined to say which officials or which crimes they discussed and said a privately appointed "grand jury" of Harney County residents, not he as a self-appointed judge, would decide whether to charge anyone with a crime.

"The grand jury will convene in private and make its decisions in private," Doucette said. "The role of a superior court judge is not very glorified. All we do is write up" what the local citizens decide, he said. .....

Hundreds of people who have used similar sovereign citizen arguments to justify failing to pay federal income taxes, getting drivers licenses or other government requirements have never prevailed in any court.

The Daily Cost Of The Bundy Occupation
by Laurel Raymond & Jenny Rowland -- Guest Contributor Jan 12, 2016 5:08 pm

Local and federal government facilities have had to be closed, keeping public employees unable to complete their work. Harney County, which houses the preserve, schools were closed last week, adding teachers to the list of employees on paid leave and preventing students from learning. Police and security has been brought in to protect the townspeople from the armed militiamen — who have threatened law enforcement and other county officials. The occupied reserve, a valuable tourist attraction for the area, is closed to recreators. All of those costs and losses add up.

Cost to the County: $70,000 Per Day

Harney County Judge Steve Grasty told outraged community members that he’d send the Bundys a bill for what they’d cost the county — which he estimates to be “$60,000 to $70,000 a day” for the closed schools and government offices and the drastic ramp-up in security. ....

This is a new development in Burns, where this event was going on for weeks before the refuge takeover, and those participants in the conspiracy to form the militia are now facing their roles in the run up to the takeover within their own community. The honorable county Judge Steve Grasty told off the fire chief in no uncertain terms for his role in forming the Harney County Committee of Safety overseeing the militia, and the fire chief told #Bundyland this evening that he took a piece of paper, wrote the date on it and "I resign" and signed it. And off he went, to join the circus.

Oregon standoff: Harney County won't host community meeting with Bundy as headliner
By Elliot Njus | The Oregonian/OregonLive January 13, 2016

Harney County has told an Ammon Bundy-affiliated group of locals that it can't hold a planned community meeting at the county-owned fairgrounds.

The location for the meeting has become a wedge between the Harney County Committee of Safety and the county government, once loosely allied in their desire for Bundy to leave town.

The self-appointed committee planned to host Bundy and Montana militia leader Ryan Payne on Friday to outline the militants' exit plan. They've said the 7 p.m. meeting will go on, with or without a meeting space furnished by the county or another community group.

"We have a longstanding practice of allowing community groups to use county facilities," said Harney County commissioner Steven Grasty. "But we unfortunately now find ourselves in a place where the county must deny those facilities to any group that is supportive of, associated with, or on the behalf of the militants at the refuge." ............

Former Forest Supervisor: Why I Resigned Over a Public Land Dispute
Gloria Flora Jan. 13, 2016

Gloria Flora is the Executive Director of Sustainable Obtainable Solutions, an organization ensuring the sustainability of public lands.

Bringing the hammer down on the Bundys won't fix the much bigger problems our lands face

Once again, a provocative armed display of dissatisfaction with a federal land management agency is unfolding—this time, at a remote wildlife refuge in southern Oregon. It’s been happening since 1848, when Mexico ceded the southwest quadrant of the United States after losing the Mexican-American War. Early settlers were primarily Mormons and Confederate Civil War refugees, both fiercely anti-federal government. Those attitudes haven’t changed much.

In the late 1990’s, when I served as Forest Supervisor of the Humboldt-Toiyabe National Forest in Nevada and eastern California, the simmering anti-federal government animosities boiled over dangerously multiple times but failed to garner much notice. Now, we’re seeing a similar boil-over in Oregon. The Nevada-based protestors, despite confusion over history and the exact purpose of their one-sided stand-off, are demanding privatization, to give the land back to “the people.” It sounds compelling, but it’s invented history.

The federal government created the Malheur National Wildlife Refuge, the focus of this standoff, by usurping the Native American Pauite Nation’s homeland, then, years later, aggregating their abandoned reservation and a used-up cattle ranch bought at a premium during the Depression.

.......... Our finite public resources are under siege by natural, economic and global forces bigger than Bundy’s boys. That demands the best stewardship we can muster—collectively.

That Night I Spent with Ammon Bundy’s Armed Militia
Inside a strange, sad media circus.
by Marnie Hanel

It was just past midnight when I noticed the five magazines of ammunition. Near a window, there was a rifle and a scope. Beside me were two members of Ammon Bundy’s armed militia—the one that had recently made national news for taking over a federal wildlife sanctuary and a smattering of buildings contained therein. All around us was complete and utter blackness. We were standing atop a watchtower, in 18-degree weather, eight rickety stories above the snow, in the middle of a remote bird sanctuary in Eastern Oregon, 30 miles from the nearest town, which was 130 miles from the next nearest town.

Thus far, it had been a pretty strange night. After dusk, I had arrived at the front gate of Malheur National Wildlife Refuge, outside Burns, Oregon. I am admittedly new to militia life, but I was surprised by what I encountered. A number of men were huddled around a campfire, gossiping and passing the time. Two hailed from Idaho and a third, an old-timer in a cowboy hat roughly the width of my shoulders, had driven in from Hermiston, Oregon, with his second-favorite horse trailer. (“Only take shit we can lose,” his wife insisted.) They were talking about the Three Percenters, a rival militia in Idaho. (“They never returned my phone calls,” said one man. “Sounds like my wife,” responded the other.) I stood by Ryan Payne, 32, the “response coordinator” of the militia. ........

Militia and antigovernment extremists illegally occupying a federal wildlife refuge in Oregon are now pledging to form a “citizen’s grand jury” to indict and bring criminal charges against public officials and judges the occupiers accuse of committing crimes and violating the Constitution.

Backer Of Bundy Militia Arrested After Building Bombs And Threatening Police
January 14th, 2016 Andrew Bradford

A man in California who calls himself a supporter of and sympathizer with the militia members who have taken over an Oregon wildlife preserve was arrested Saturday and charged with building bombs and making threats against law enforcement officials.

Kern County deputies received a tip that Tood Sloan had been making online threats against local and federal law enforcement officers. Upon serving a search warrant at Sloan’s house, police found improvised and commercial explosives and “booby traps” throughout the residence.

Sloan was immediately arrested and charged with three counts of possession of a destructive device or explosive near a public place, three counts of making a destructive device without a permit, three counts of possessing a destructive device, and one count of being in possession of a firearm while on probation. He is being held on $2 million bond.

Sloan first came to the attention of law enforcement when he left bizarre comments on the website for the Daily Independent newspaper, one of which read:

I don’t pay tax revalation (sic).

On Facebook, Sloan also made rambling postings such as this:

Months before Malheur occupation, another Oregon land dispute galvanized militants
By Rob Davis | The Oregonian/OregonLive January 13, 2016

What's unfolding in Harney County isn't Oregon's first go-round with camouflaged, heavily armed militants challenging the federal government.

Another event just nine months ago drew far less attention. But those who watched it closely say it emboldened and further galvanized the militant movement a year after the 2014 Cliven Bundy ranch standoff in Nevada.

Oregon's first serious encounter happened last April. It played out in rural Josephine County in southwestern Oregon, in a mountainous stretch of timber country along the Rogue River.

Many of the same players have shown up at the Malheur National Wildlife Refuge. Two are among the compound's occupiers.

The Sugar Pine Mine dispute started when two gold miners, Rick Barclay and George Backes, received a non-compliance letter from the Bureau of Land Management that disputed their mining rights. ............

Oregon standoff Day 14: What you need to know Friday
By The Oregonian/OregonLive January 15, 2016 at 5:01 AM

As we enter Day 14 of the standoff at Malheur National Wildlife Refuge, here are the latest developments:

● The militants say they will meet with the community on Friday and announce a departure plan. Whether that will be a restatement of their demands or something new remains to be seen.

● As the armed occupation of a Harney County wildlife refuge drags into its 13th day, protesters are sending mixed signals about their plans. .........

BundyBunch bunch built a road at the refuge yesterday
By cany Friday Jan 15, 2016

Heartbreaking.

Apparently, the road was built between the kitchen and some other buildings farther away. Not only is this a wildlife refuge, those familiar with the property have indicated there are sensitive archaeological sites, including both Native American burial AND reburial sites, on the lands.

I do, however, remain of the opinion that we must wait these folks out. I do not agree that food and other supplies, mail etc. should enter. But I believe strongly that a heavy hand will cause all kinds of other problems. .........

Growing number of police chiefs, sheriffs join call to arms: http://fxn.ws/1ZAKeNp by @CDerespina

The Oregon State Sheriffs' Association (OSSA) continues to stand with Harney County Sheriff David Ward
Oregon State Sheriffs' Assoc. - 01/14/16 9:45 AM

Many OSSA member agencies -- along with many city police departments and the Oregon State Police -- have sent personnel to help Sheriff Ward patrol the community and maintain public safety during this critical time.

We continue to be asked when the standoff at the Malheur Wildlife Refuge will end, and which agency will make that decision. We'd like to clarify the jurisdictional situation.

The FBI is in charge of making and implementing plans to end the siege. The FBI has jurisdiction over the armed takeover of the federal buildings in the refuge, as well as any crimes committed therein. Questions about the standoff should addressed by the FBI, which continues to work diligently towards a peaceful solution.

Meanwhile, Sheriff Ward and other local law enforcement agencies are directly addressing militia activities outside the wildlife refuge -- including the well-chronicled harassment and intimidation of residents, federal employees and law enforcement by militia members and associates.

OSSA stands proud in saying that Sheriff Ward has done a commendable job fulfilling his oath as Sheriff and defending his community. Sheriff Ward has made every effort to peacefully defuse the situation and return normalcy to the residents he serves. He has worked tirelessly with his fellow law enforcement partners to develop strategies to protect and serve Harney County while the FBI continues its investigation.

OSSA and its law enforcement partners will continue to offer support to Sheriff Ward and his team until this situation is resolved. We couldn't be prouder of the work he has done to serve Harney County and Oregon.

Sheriff Brian Wolfe
Malheur County Sheriff, OSSA President

Harney County - Individual arrested in connection with stolen refuge vehicles - 01/15/16
An individual is in custody in connection with stolen Malheur National Wildlife Refuge vehicles.

Shortly after noon on Friday, January 15, 2016, Oregon State Police arrested Kenneth Medenbach, 62, of Crescent, Oregon, at the Safeway in Burns, Oregon. He was arrested on probable cause for unauthorized use of a motor vehicle.

Law enforcement officers recovered two vehicles stolen from the Malheur National Wildlife Refuge.
U.S. Fish and Wildlife Service (USFWS) had previously reported the vehicles stolen to the Harney County Sheriff's Office.

OSP troopers and deputies from several county Sheriff's offices responded to the scene.
"The U.S. Fish and Wildlife Service is grateful for the quick actions from law enforcement," said USFWS spokesperson Megan Nagel. "We will continue to work with law enforcement to recover vehicles bought and paid for by the American people to care for their national wildlife refuge."

Holding signs that read "Birders against bullies," protesters took to the street in Bend, a two-hour drive from where a group of occupiers have held the Malheur National Wildlife Refuge for two weeks.

Refuge supporters also have taken to Twitter -- #RefugeRally and #SupportMalheur -- and Facebook, where they are calling on more arrests to be made and posting pictures they have taken over the years at the refuge.

One birder, Cody Martz, showed up at the refuge Friday to speak to reporters and offer a counterpoint to the armed occupants ....

Burns Paiute Tribe seeks federal prosecution if artifacts disturbed
Tribal council designates refuge as 'traditional cultural property'
January 15, 2016 Pat Dooris/KGW.COM

The Burns Paiute Tribe on Friday asked the U.S. Fish and Wildlife Service to protect its important cultural resources at the Malheur National Wildlife Refuge, and to prosecute occupiers for any damage or destruction they cause.

In a letter to U.S. Fish and Wildlife Service Regional Director Robyn Thorson, Tribal Chairperson Charlotte Rodrique asked for greater protection for cultural resources at the refuge, specifically asking for an inventory of archeological resources at the refuge headquarters, and for criminal prosecution for violators of the Archeological Resources Protection Act.

Rodrique expressed grave concern over news reports that armed militia have access to important cultural resources at the Malheur National Wildlife Refuge.

“Armed protestors don’t belong here,” Rodrique said in a news release. “They continue to desecrate one of our most important sacred sites,” she continued. "They should be held accountable.”.........

HOW DOES BUNDY WANT THE ARCHEOLOGICAL SITES HANDLED?

Bundy said people interested in archeology are welcome to explore the refuge, but that cattle ranchers and loggers should have priority when it comes to land use.

"Before white man came, so to speak, there was nothing to keep cattle from tromping on those things," Bundy said.

Though some countries had domesticated cattle 10,000 years ago, the animals came to the United States with European settlers.

"We also recognize that the Native Americans had the claim to the land, but they lost that claim," Bundy said. "There are things to learn from cultures of the past, but the current culture is the most important."

Guest Opinion: Walden works against our public lands
By Dave Strahan Jan. 17, 2016 at Medford, Oregon

I could not be more disappointed in Congressman Greg Walden’s response to the armed takeover of the Malheur National Wildlife Refuge by anti-government militants. He states that he “understands their passion,” of taking over public buildings, tearing down wildlife fences and threatening public employees. ..... Walden is missing the point here.

Our shared heritage of public land belongs to all Americans, including many of his constituents throughout rural Oregon who depend upon those lands for hunting, fishing and camping, as well as our livelihoods. .....

Rather than standing up for Oregonians and law enforcement officers, Walden has renewed his push against public lands and resources and enacted the very goals espoused by those who have taken over the Malheur National Wildlife Refuge. While Congressman Walden has been outspoken about his anger concerning public lands management, he has been curiously silent about the estimated $15 million that visitors to the Malheur Wildlife Refuge provide to local economies annually. ..........

Walden is sponsoring legislation that would remove over a million acres of forests in Western Oregon from public management and place them in a timber trust to be logged for the benefit of timber corporations. Also, Walden released draft legislation to give over a quarter million acres of national forests in Southern Oregon and northern California to political allies. Handing over public lands is not stewardship, it is simply a form of political patronage. .........

Oregon Militia Brings Battle Back to Malheur Reservation

Sarah Winnemucca isn’t a name known by many—her surname is more likely identified as a town in Nevada than the last name of one of the nineteenth century’s most prominent American Indian writers and activists. Author of Life Among the Piutes, one of the first published narratives by a Native American, she made frequent headlines for her vocal support of indigenous rights. One of her most long-lasting campaigns was to restore her people, the Northern Paiutes, to the Malheur Reservation, which was created in 1872 by the U.S. government. In January 1879, following the Bannock War, residents of the reservation were forced to travel 350 miles to the Yakama Indian Reservation after an ill-informed decision to punish the Northern Paiutes, many of whom had supported the US against the Bannocks in the War. Even the so-called “hostiles” in the war were motivated by the usual: colonialist land encroachment and resource exploitation.

Because of our collective amnesia about both Winnemucca and Malheur, I was surprised to see the site make first-page news across the country last week, when members of a militia group took over the Malheur Wildlife Refuge in order to protest the US government’s possession and management of public lands in the West.

Malheur—known now mainly to birders who prize species like the Sandhill Crane—has been a contentious site before. Nineteenth-century newspaper articles that Carolyn Sorisio and I published in the collection The Newspaper Warrior: Sarah Winnemucca Hopkins’s Campaign for American Indian Rights 1864-1891 (University of Nebraska Press 2015) indicate that the rightful owner of Malheur was a contested question long before the militia’s current occupation.

The Malheur Indian Reservation was established for the Northern Paiutes in 1872 by President Grant. .....

Before Bundy, Bird Hats: Malheur’s Bizarre History

The history and law behind Utah’s bid to gain federal public lands
By BRIAN MAFFLY | The Salt Lake Tribune Jan 19 2016

In the 1780s, Maryland was worried about its neighbors as America's newly independent states pondered how to bind 13 former British colonies into a single nation.

Virginia and Pennsylvania envisioned their borders extending far into "unoccupied" land to the west, and Maryland feared that its influence would wane should those states gain large empires. It insisted these lands be reserved for future states and sold to pay down a massive war debt and fund ongoing government operations.

The historic compromise to resolve this impasse led to the principles Utah is now invoking as it builds a legal case to demand that the federal government hand over title to 31 million acres of public lands.

To persuade Maryland's leaders to sign the Articles of Confederation, other states agreed that all future states would join the union on "equal footing" with the original 13, making the young nation a federal republic of sovereigns, according to the legal analysis recently unveiled by consultants hired by the Utah Commission for the Stewardship of Public Lands.

Understanding the Oregon Standoff
January 19, 2016 by The Beacon by Rachel Rippetoe

... we have people arguing that these men are militia. They’re armed and they actually are damaging property. They’re saying that this should be treated as terrorism. How are we supposed to go about this as a nation?

Well, usually you think of terrorism as being either the attempt to take life or threaten to take life in order to advance a political goal. The fact that these guys are armed and won’t leave and they’re threatening that if the authorities try to force them to leave, they will meet that force, certainly takes us beyond legal protest. On the other hand, I don’t think they’re all the way to terrorism yet. It would be one thing if they were taking hostages or if they started blowing up the building, but I don’t think tearing down a fence really counts. It’s “terrorism-light,” if that. ....

Oregon standoff: Anger, frustration boil over at community meeting w/ 31 Photos
By Les Zaitz | The Oregonian/OregonLive January 19, 2016

... In sometimes highly personal remarks, speaker after speaker vented anger – at public officials, at the federal government and at the man in the brown cowboy hat sitting high in the bleachers to take it all in – Ammon Bundy. ...

He sat on the second row from the top as County Judge Steve Grasty, microphone in hand, strode to the foot of that bleacher section.

"It is time for you to go home," Grasty said to Bundy, vowing to meet with Bundy anytime, anyplace – outside of Harney County.

A chant then grew in the gymnasium: "Go, go, go, go, go." .....

Oregon standoff leader attends meeting, hears chants of 'go'
Lisa Baumann, Associated Press, January 20, 2016

... "Ammon, you need to go home to your family; thank you," said local resident Jennifer Williams. "I've heard so many things I didn't know before. Now I'm aware."

Other speakers were less congenial and at times angry and emotional in comments directed at the armed group as well as at local government officials and federal government, in part for not doing more to end the occupation. ....

.... Harney County Judge Steve Grasty took the microphone over to where Bundy sat in the bleachers and told Bundy he'd drive him wherever he wanted to go, as far as Utah. ....

Oregon Gov. Brown On Burns: 'Spectacle Must End'

In a press conference Wednesday where Oregon Gov. Kate Brown announced her policy agenda, she took aim at federal officials.

The governor said federal officials have told to her to limit her public comments to avoid escalating the ongoing occupation at the Malheur National Wildlife Refuge near Burns, Oregon.

Brown called the occupation “intolerable” and pushed for a quick resolution.

“Federal authorities must move quickly to end the occupation and hold all of the wrongdoers accountable,” Brown said.

“This spectacle of lawlessness must end.” ........

Oregon standoff: One of protesters has murder conviction
Rebecca Woolington | The Oregonian/OregonLive January 20, 2016

One of the protesters taking part in the armed occupation at the Malheur National Wildlife Refuge is a 68-year-old former woodworker and, according to court records and authorities, a convicted killer.

Neil Sigurd Wampler drove to Oregon from his home on the California coast earlier this month to join those protesting the arson convictions of father and son ranchers outside Burns.

In August 1977, Wampler, who was 29, was convicted of second-degree murder in the killing of his father .........

..... A commander at the San Luis Obispo County Sheriff's Office also confirmed that the man at the refuge is a convicted murderer he knows as Neil Wampler in California .....

California and federal law generally prohibit felons from possessing firearms. Wampler told The Oregonian that he can legally possess a gun. Cipolla, the San Luis Obispo Sheriff's Office spokesman, said Wampler cannot have a gun because of his murder conviction. ....

...He pleaded ... not guilty by reason of insanity ...... "I myself am willing to be shot and killed for constitutional rights and principles." ......

By: T. Grant Benson (Breaking911 Newsroom) January 21, 2016 | 6:45 PM

“The FBI recognizes that many in the community have questions about why we are here and our role in helping to end the occupation of the wildlife refuge. We are here to work closely with Sheriff Ward and our local, state and federal partners to protect the safety and welfare of this community. This occupation has caused tremendous disruption and hardship for the people of Harney County, and our response has been deliberate and measured as we seek a peaceful resolution.
