Attorneys: 'Affluenza' teen to return to Texas within weeks

FORT WORTH, Texas (AP) — A teenager who used an "affluenza" defense in a fatal drunken-driving wreck will return to Texas from Mexico within weeks, and his case will likely be transferred from the juvenile to the adult system, his attorneys said in a statement Wednesday.

Ethan Couch has been challenging his deportation, but paperwork was filed to "terminate the ongoing immigration proceedings," attorneys Scott Brown and Reagan Wynn said in the statement.

. . .

"It's not a foregone conclusion that this will happen, but we certainly hope it does," said Tarrant County district attorney spokeswoman Samantha Jordan.

He would then finish out his 10-year probation under the supervision of an adult court. If he were to violate his probation, he could face up to 10 years in prison per death.

How many times does he have to violate it before he goes to prison? 2? A dozen?

Why does he need to violate it again, considering he already violated it?

that he instead become a model citizen and demonstrate that probation is a viable option for myriad young men and women that are trapped within the criminal justice system.

Intuition tells me that probation violations are common, especially during the initial period of adjustment to a life of new restrictions.

We would be ill-served if his example on the macro level convinces legislatures and judges that probation isn't worth it and they instead just skip ahead to long prison sentences.

I want the lesson learned to be "Look how probation worked even for the jerk without a conscience" instead of "Lock them all up and lose the key, probation wouldn't even work for someone with all life's advantages."

It's appropriate to blame him for what he did, but not for the judge's stupidity.

If he has Affluenza, there is no reported cure so he is a constant danger to society.

He would finish his probation here..........the key word being "finish???"
Since he violated his probation already, why would he be allowed to finish? Why not throw the little shit in prison for the next 40 years?

What's up with this nonsense? Didn't he violate his probation already? How many times is he allowed to violate this probation before he faces actual prison time?

I am no legal expert but since the original sentence was obtained in a minor court case the TX prosecutor apparently is going to deal with the escape by changing the case to adult court but he has not violated adult court yet so they are probably going to place him on fairly strict adult probation and then wait..

He doesn't seem like he's going to be a good boy for the next 10 years. He couldn't even wait 30 days in Mexico without going to a strip club (where his mom had to bail him out after he got in over his head). The dude can't seem to stay away from alcohol.

Boy steps over the line, government - OK that's it, if you do it again, you are in trouble. Boy steps over the line again, government says OK that's it, if you do it again, you are in trouble. Rinse and repeat indefinitely.
