South Dakota Governor Vetoes Bill Stipulating Transgender Students' Bathroom Use

Gov. Dennis Daugaard has vetoed a bill that would have required transgender students in South Dakota's public schools to use bathrooms, locker rooms and other facilities based on their gender at birth.

Daugaard issued the veto Tuesday afternoon on a bill that would have become law at midnight if he had taken no action.

Opponents of the measure, including the American Civil Liberties Union and the Human Rights Campaign, had called on Daugaard to veto the bill.

"Proponents of House Bill 1008 say it protects students' privacy," South Dakota Public Radio reports. "Opponents say it's discrimination."

This is huge news and a win for transgender and gender non-conforming students in South Dakota. Introducing elected officials to trans folks and educating them on trans issues really pays off. Another day, another win!

Let a local school district be forced to pay for the litigation when they face a discrimination lawsuit for violating Title IX.

The immediate go-to of people who support that legislation is to paint the opposition as 'friends of child molesters'. They have reams of sob stories that don't actually apply to the issue, and plenty of venues to be shrill about it.

The right wing noise machine is difficult to ignore.

I'm glad he did that.

I suspect since he's term limited and the SD Governor isn't elected until 2018 that he felt comfortable enough doing that, hoping the teabags will forget that by 2018. Otherwise I'm guessing he would have signed it into law.
