Alabama Supreme Court Chief Justice Roy Moore suspended for rest of term

Alabama Supreme Court Chief Justice Roy Moore has been suspended from the bench for telling probate judges to defy federal orders regarding gay marriage.
The Alabama Court of the Judiciary (COJ) issued the order Friday suspending Moore from the bench for the remainder of his term.

"For these violations, Chief Justice Moore is hereby suspended from office without pay for the remainder of his term. This suspension is effective immediately," the order stated.
The court found him guilty of all six charges of violation of canon of judicial ethics.

Moore's term is to end in 2019. Gov. Robert Bentley will name a replacement for Moore.

The suspension was imposed by the state’s Court of the Judiciary, a nine-member body made up of selected judges, lawyers and others. While the court did not remove Chief Justice Moore from the bench entirely, as it did in 2003 after he defied orders to remove a giant monument of the Ten Commandments from the state judicial building, it effectively ended his career as a Supreme Court justice. His term ends in 2019, and Chief Justice Moore, 69, will be barred by law from running again at that time because of his age.

Moore's attorney stated:

"A majority of this court also agrees with the JIC that the only appropriate sanction for Chief Justice Moore is removal from office. Removal of a judge from office, however, requires 'the concurrence of all members sitting ... It is clear there was not a unanimous concurrence to remove the Chief from office, so the COJ suspends him for the remainder of his term. In other words, the COJ did what the rules say they cannot do. There is no meaningful difference between suspension for the remaining of the term and removal from office.


I agree with his argument. I wonder if it would have been cleaner from an appeals standpoint if they ended the suspension without pay one day before his term would have ended.

A former Alabama attorney general went after Moore once.

He is William Pryor, Jr., now near the top of Trump's SCOTUS nominee list.

This doesn't sound connected to this situation until you know that this Eleventh Circuit judge has called Roe v. Wade "the worst abomination in the history of constitutional law."

Being Catholic and raised in Alabama makes one as conservative as they come. Trump's troops would essentially return the Court to where it was before Scalia's death. Spurring southern votes with this suspension will help toward that end.

Call me conspiratorial, but I lived in the South and this is how Republican southern strategists think.
