Trump fires acting Attorney General Sally Yates
Source: CBS News
WASHINGTON -- President Trump fired acting Attorney General Sally Yates after she ordered Justice Dept. lawyers to stop defending President Trumps executive order banning new arrivals to the U.S. from seven Muslim-majority countries.
The acting Attorney General, Sally Yates, has betrayed the Department of Justice by refusing to enforce a legal order designed to protect the citizens of the United States, the White House said in a statement on Monday night. This order was approved as to form and legality by the Department of Justice Office of Legal Counsel.
The White House said President Trump relieved Ms. Yates of her duties and named Dana Boente, U.S. Attorney for the Eastern District of Virginia, to serve as Acting Attorney General. The White House said he would serve until Senator Jeff Sessions is finally confirmed by the Senate, where he is being wrongly held up by Democrat senators for strictly political reasons.
I am honored to serve President Trump in this role until Senator Sessions is confirmed, Boente said in the statement. I will defend and enforce the laws of our country to ensure that our people and our nation are protected.

(25,183 posts)Or issue the same defiance.
A lot of people remember the Saturday Night Massacre for Archibald Cox, but Elliot Richardson and William Ruckelshaus were involved in that Cox-sacking. Both Richardson and Ruckelshaus wanted to protest the firing, and they resigned their offices over it. A certain Robert Bork was more than willing to abide by the termination of Cox.
Trump and his henchmen were looking for someone to make an example of from day one, I didn't think they'd get one in the first ten days of the administration. We'll see if anybody else steps forward to put their job, or even their career on the line.

(6,344 posts)In January 2017, according to a Justice Department spokesman, Yates accepted a request from the incoming administration to serve as Acting Attorney General, beginning on January 20, 2017, and until the successor for Attorney General Loretta Lynch can be confirmed by the United States Senate.[7] On January 30, President Donald Trump was critical of Democratic members of the Senate, saying they were delaying his cabinet nominees.[8]
On January 30, 2017, Yates ordered the Justice Department not to defend Trump's Executive Order "Protecting the Nation from Foreign Terrorist Entry into the United States", saying "At present, I am not convinced that the defense of the executive order is consistent with these responsibilities [of the Department of Justice], nor am I convinced that the executive order is lawful".[9][10]. A few hours later, she was relieved of her duties by Trump and replaced by Dana J. Boente.[11]

(60,010 posts)and traditionally every US attorney is replaced by the incoming President at some rate of speed.
Presidents can hire and fire and transfer US Attorneys.
Most of them have managed to do it with some veneer of politeness and adult behavior, but Trump remains true to his petty and crass ways.

(5,624 posts)Washington, D.C. Democratic Leader Nancy Pelosi released the following statement after it was announced that Acting Attorney General Sally Yates was fired by President Trump:
Tonight, the Acting Attorney General was fired for upholding the Constitution of the United States. What the Trump Administration calls betrayal is an American with the courage to say that the law and the Constitution come first.
President Trumps executive order violates the Constitution, dishonors our values, and weakens the security of the United States. National security experts are warning that the Presidents ban will make it harder, not easier to defeat terror.
Earlier tonight, House Republicans blocked Democrats emergency bill to rescind this dangerous and unconstitutional executive order. Now, President Trump has fired the Acting Attorney General to get the answer he wants. Republicans will have to decide whether they will be complicit in the Presidents reckless, wrathful and unconstitutional agenda.
