Omaha man who resisted giving DNA samples is ordered to stand trial in 4 sexual assault cases

A 41-year-old Omaha man who resisted giving authorities his DNA samples while in prison was ordered Monday to stand trial in Douglas County District Court on four counts of first-degree sexual assault.

Brandon Weathers faces up to 50 years in prison on each count if convicted. He currently is serving consecutive sentences of 50 to 80 years each for two counts of first-degree sexual assault of a child.

Omaha Police Officer Gregg Grossoehmig testified Monday at a preliminary hearing that DNA evidence shows four women were assaulted by Weathers. The assaults occurred in their homes between Sept. 16, 2002 and June 5, 2004.

In each case, the officer said, a man entered through a window in the early morning hours, threatened the women with a knife, bound them and used a video camera to record the assaults.

that sounds a little authoritarian.

If I was his attorney, I would almost certainly raise a 4th amendment defense.

I agree with you insofar as taking one before conviction being a 4A violation.
