White House counselor Kellyanne Conway violated the Hatch Act on two occasions, the Office of Special Counsel (OSC) informed the Trump administration Tuesday.
Appearing in her official capacity, Conway endorsed and advocated against political candidates, the watchdog said, referring its findings to President Trump for disciplinary action.
The violations occurred during two television appearances in 2017, one on "Fox and Friends," and one on CNN's "New Day."
Ms. Conways statements during the Fox & Friends and New Day interviews impermissibly mixed official government business with political views about candidates in the Alabama special election for U.S. Senate, OSCs report reads.
This breaking news story will be updated.

UPDATE:
Office of Special Counsel tells Trump to punish Kellyanne Conway for violating the Hatch Act twice

The Office of Special Counsel found that senior White House advisor Kellyanne Conway violated the Hatch Act twice when she appeared in two separate interviews.
When discussing Ivanka Trumps brand, Conway made a direct plea to the Fox News audience to buy Trumps products. The second case was when she advocated for Alabama senate candidate Doug Jones to be defeated and advocated the election of Roy Moore.
Both are explicitly banned by the Hatch Act. According to the special counsel, their office submitted the report to the President for appropriate disciplinary action.

(14,270 posts)It should result in a fine of up to $1000 along with termination from her federal office. She should be barred from working in the federal government for a minimum of five years.
That said, I would prefer to see her locked up too. Unfortunately, this violation won't make that happen.

(50,453 posts)In the old days it was so broad that a person from NJ who met a woman in a NYC bar and took her back to his home could be charged with a federal crime. The current version of the Act requires that the sex be illegal, like prostitution, before the Mann Act applies.
Kellyanne does not, as far as we know, engage in prostitution. (Unlocking the doors of power with your vagina is not prostitution.)

(98 posts)Consequences for violating the Hatch Act range from a letter of reprimand to a civil penalty of up to $1,000 to suspension, termination or even debarment from federal employment for up to five year
I don't like Kellyanne but you really want to jail someone for advocating for a candidate while they're working in the White House?

(42,379 posts)and by law the worst "punishment" is dismissal, which is discretionary and rarely imposed. (Other options are reduction in grade, debarment from federal employment for a period not to exceed 5 years, suspension, reprimand, or a civil penalty not to exceed $1,000. )
And the decision about what penalty to impose is a matter of administrative discretion.
The DOJ Office of Inspector General initiated a investigation into whether Comey violated the Hatch Act but once he was fired, the investigation ended since there was no point in continuing.

So those yelling prosecute, lock her up, etc. are just demonstrating their lack of knowledge of the law. She'll get a warning, which is what happens the vast majority of Hatch Act violation cases. Findings by the OSC that the Hatch Act has been violated are not uncommon. Dismissals are very uncommon.
