Minnesota candidate posts revenge porn on campaign blog after wife's restraining order

An unhinged Minnesota city council candidate is under investigation for posting a topless photo of his wife to his official campaign website in response to an order of protection she filed against him.
In a July 14 blog entry on the now-deleted page, David Martinez of St. Paul included the picture alongside a heated commentary on the couples marital troubles and a copy of the restraining order cops had served him one day earlier.
Martinez has a history of restraining me physically against my wishes and forcing himself on me, his estranged wife wrote in the document, in which she requested and was granted full temporary custody of their two children.
His behavior has continued to escalate over the past 3-4 weeks, she wrote. He has been diagnosed with major depression in the past, and his mental state seems to be impacting his behavior.

Minnesota's revenge porn statute could give him three years in prison for this meltdown.

(5) the actor disseminates the image with intent to harass the person depicted in the image;
(6) the actor obtained the image by committing a violation of section 609.52, 609.746, 609.89, or 609.891; or
(7) the actor has previously been convicted under this chapter.

Never, ever, under any circumstance, allow ANYONE to take a photo of you if you're not fully dressed. Swimsuits count as fully dressed.

(22,651 posts)According to the restraining order documents on his website, Meredith Martinez said that during the July 4 altercation her husband put both of his hands around my neck and pushed me backwards into a shelving unit with his hands still gripped around my neck.
On July 5, David Martinez was banned from the citys public library system for a month following his arrest at the downtown George Latimer Central Library.
The next day, July 6, he was ejected from Target Field and banned from the ballpark for a year following a physical confrontation with security.
Meredith Martinez added that on July 11, he brought home several canisters of mace and a pellet gun, telling her that people were threatening him.
The couple work on the same floor of the Minnesota Department of Health building. He is ordered to stay away from her at work, according to the document.

The St. Paul City Council candidate was arrested "without incident" by St. Paul Police on Monday morning, according to department spokesman Steve Linders, who gave the time and location of Linders' arrest as 7:30 a.m. on the "80 block of East Seventh Place." That would put Martinez near the Minnesota Department of Health building in downtown St. Paul.
Martinez worked out of that building, as does his wife, who filed a restraining order against the city council candidate last week, alleging he'd physically assaulted her on July 4. In response to that order for protection -- which mandated that he stay away from his wife and their home -- Martinez published a topless photo of his wife on his campaign website.
