In Thursday's filing, his lawyers argue that the House Judiciary and Oversight committees "have conducted an investigation in a manner that exceeds a proper legislative purpose insofar as members of the committees have established a practice of selectively leaking witnesses' testimony in order to support a false political narrative, while subjecting witnesses to a variety of abuse."
"Mr. Comey asks this Court's intervention not to avoid giving testimony but to prevent the Joint Committee from using the pretext of a closed interview to peddle a distorted, partisan political narrative about the Clinton and Russian investigations through selective leaks," his lawyers added in court papers.

The legal action from the controversial former FBI director showed Comey was making good on a pledge to push back against the demand from House Republicans for a private deposition.

House Judiciary Chairman Bob Goodlatte and other House Republicans have been looking into Justice Department actions during the 2016 campaign, and -- in one of Goodlatte's final acts in power -- the outgoing Virginia Republican issued subpoenas for testimony from Comey and former Attorney General Loretta Lynch.
In their filing on Thursday, Comey's lawyers claimed Republicans would leak parts of his testimony "to mislead the public and to undermine public confidence in the FBI and the DOJ during a time when President Trump and members of his administration and campaign team are reported to be under investigation by Special Counsel Robert Mueller and other law enforcement authorities."...........................

(3,131 posts)New congress starts Jan 3. It's Nov 29. They have to avoid a shutdown by Dec 7 and they aren't giving up vacation for this testimony. At least I don't think so. But I don't put anything past them.
I have no idea if a decision on quashing a subpoena can be appealed.
I'll put a dollar on Comey isn't testifying.

(10,711 posts)But its hard to get around the reality that the 2016 election was swung to Trump by an untimely and (in reptrospect) inexplicable announcement from Comey. That's a historical fact. I'd like to know more about it. If Comey wants openness and honesty, that's all well and good, but forgetfulness is not to be expected.
Sometimes the enemy of my enemy is still a piece of shit, but if there's more to the story, I would like to hear it.

(5,914 posts)He was presented with a "fecal duality" (two shitty choices), and he, unfortunately, chose the one that, in retrospect, makes it look like he was trying to torpedo Hillary. I truly believe that was not his intention.
Remember that at the time, no one thought Trump would actually win. He wouldn't have won, if there hadn't been Russian shenanigans.
Comey seems to have been clamoring for openness and transparency throughout all these sham Republican investigations. That's not the pattern of someone who's sneaky or nefarious.

WASHINGTON (Reuters) - A federal judge on Friday delayed a decision on whether to block U.S. House Republicans from compelling former FBI Director James Comey to testify next week in secret about his actions on investigations leading up to the 2016 presidential elections.
Judge Trevor McFadden, who was appointed to the U.S. District Court for the District of Columbia by President Donald Trump, said he wanted to review the case over the weekend before making a ruling and scheduled a follow-up hearing for Monday at 10 a.m.
He also told Comeys attorney, David Kelley, to submit a follow-up brief to help inform his opinion by Sunday afternoon.
Fridays hearing came about after Comeys lawyers this week asked the court to quash a Nov. 21 congressional subpoena ordering him to appear before the House of Representatives Judiciary Committee for a closed-door deposition and stay the congressional proceedings.
