Omaha bar owner who fatally shot protester is evicted from downtown property

The owners of the downtown Omaha property in which The Hive bar operated said Tuesday that they have evicted the tavern operator, Jake Gardner.

Contacted by The World-Herald, the property owners, who said they have been the target of threats, said neither The Hive nor the Gatsby would be allowed to open again in the space in the building near 12th and Harney Streets.

Gardner, 38, was a tenant who owned the side-by-side Gatsby and The Hive operations.

Gardner fatally shot 22-year-old James Scurlock on Saturday night during a demonstration in downtown Omaha. Monday, Douglas County Attorney Don Kleine announced in a press conference that Gardner would not be charged in the shooting. Kleine said he and other law enforcement officials concluded that Gardner had acted in self-defense when he shot and killed Scurlock. Gardner still could face misdemeanor charges or citations in the incident.

They may be able to terminate a lease with notice, but that is not a court ordered eviction.

The owners are liable for any shots fired especially if any left the property. This isn't over

arising from the behavior of the tenant. No warning needed, no 30 days to resolve differences, no ifs, ands, or buts. His behavior put their property at risk. That is more than sufficient and quite normal in commercial rentals.

sounds like the building owner owes the bar owner a huge debt of thanks. The building stands at this time. No promises about tomorrow. Seems to me a deal should be worked out. They could be fighting over a pile of ashes.

I have one tenant riding that shit train to the end of the tracks. State Supreme Court has all courts shut down until at least 6/13, and THEN you're in line in order of filing the notice to evict. And no, she's not delinquent because of Covid.

Regarding:

Perhaps the property owners did say that. That was probably not what they actually did.

Eviction is generally the action to remove the tenant after a lease is terminated. The news article here does not say if the lease was previously terminated. Perhaps the actual event being reported is that the property owners have giving the bar owners notice to quit.

I suspect this is due to threats received by the property owners and possibly due to their genuine feelings or perhaps simply as an act of public relations. The bar owner, Jake Gardner, may have negotiated this with the owners. Closing the 2 bars takes him out of the eye of the some of the public who clearly hate him. This also leaves the property owner in a good light with the community.
