Fort Hood sergeant says he shot and killed armed Black Lives Matter protestor

An active-duty Army sergeant from Fort Hood says he was the one who shot and killed a man at a Black Lives Matter protest in Austin, Texas, last weekend, according to the sergeant's attorney.
Sgt. Daniel Perry said he fired at Garrett Foster out of self-defense after Foster allegedly raised an assault rifle toward Perry, according to a statement from the attorney obtained by The Washington Post.
According to the statement, Perry was driving for a ride-share company in downtown Austin on the night of July 25 when he turned a corner toward a protest he did not know was taking place.
At that point, the attorney says protesters began beating on Perry's car. Foster then allegedly approached the car window holding an assault rifle.

I think some protesters may have taken a pic of his plates, but this is the first of his name.

(25,201 posts)I saw video of Foster with his gun, 15 minutes before he was killed. It was strapped.
The question is whether Foster pointed his rifle at Perry.
Also Perry did not stop at the red light. He made a right turn on red without stopping. This complicates things, because what do you expect when you drive into a group? Of course they're gonna panic and bang on windows.

(2,177 posts)In fact, he stepped in front of his girlfriend who was in a wheelchair to shield her, and got shot. I did not see the video so I cannot corroborate it, but it would not surprise me if that was the case.

Details of the shooting confirmed by Austin police
Many of the details in the attorney statement align with what Austin police say the driver who shot Garrett Foster told them.
During the initial investigation of this incident, it appears Mr. Foster may have pointed his rifle at the driver of this vehicle prior to being shot, Chief Manley said in an update about the shooting on Sunday.
A photo of Garrett Foster and his fiancée from the GoFundMe page launched to pay for his funeral expenses.
The chief elaborated that the drivers account is that Mr. Foster pointed the weapon directly at him.
After the shooting, Chief Manley confirmed that a person did call 911, saying someone approached the driver-side window of their vehicle and pointed a rifle at them.
The department says both Perry and the second shooter have concealed handgun licenses. At this point, no one has been charged in connection to this incident.

My takeaway: Broden just declared open season on open carry, y'all! There's a reason he says "raises an assault rifle in their direction" instead of "points an assault rifle at them," but let's roll with it: when Solid Snoke from Meal Team Six waddles up with his Cheeto-dusted bang-bang, you're free to defend yourself.

(2,146 posts)he looks and acts like an infiltrator / instigator, maybe one of the Proud Boys. On the surface this looks like a PB came to start something by waving his AK around. Look at the way the guy is dressed -just like the PB protesters from all over. But he ran into yet another White supremacist in a car who shot him.
PS while I don't know Army Rules, isn't there a prohibition against using a service issued weapon to shoot civilians who have not shot at you first?

He was not a white supremacist. His fiancee was a black woman in a wheel chair. I got the impression that most of the core BLM group protesting were disaffected type people.

(1,142 posts)I saw another article where the victim was armed for protection and that multiple witnesses said he never pointed his rifle at the man or car, but was concerned that the driver was going to drive into the crowd and since his wife is a quadriplegic he was concerned that the driver was aiming his car at her because she was an easy target, so he went to approach the car and was shot dead

(2,971 posts)I would be shocked if he used a service issued weapon. Those are kept secured on the base. I read in another story that he had a concealed carry permit, so presumably he was using his own privately owned firearm.

Either way, he was not. His fiancé was a black woman in a wheelchair. He had been out protesting for 50 straight days, and was very much against police violence.

His shoulders and arms would naturally raise in response to a car careening into his space. It could be easy for a driver to misinterpret this.
It really happened very fast.
The driver failed to stop before making a right hand turn on red. He also did not even appear to a perform rolling yield. I thought maybe alcohol was involved on his part.
