Republicans File Election Day Lawsuit Aimed at Mail-in Ballots in Pennsylvania

A pair of Republicans in Pennsylvania filed a lawsuit on Tuesday claiming that election officials in Montgomery County, a suburban area just outside of Philadelphia, have unlawfully counted mail-in ballots before Election Day and only contacted some of the whose ballots have been found deficient to correct them before polls close.

The suit was filed in U.S. District Court for the Eastern District of Pennsylvania by Kathy Barnette, a Republican congressional candidate, and Clay Breece, the chairman of the Berks County Republican Party.

“In Montgomery County, the Board of Elections is not only deviating from the standards set forth in the Pennsylvania Election Code, they have substituted and are implementing their own arbitrary standards by illegally pre-canvassing mail-in ballots received before November 3rd and, in certain instances, providing the electors submitting such illegally pre-canvassed ballots that are found to be deficient an opportunity to re-vote on or before November 3rd,” the complaint stated.

Vote tallying is not permitted in Pennsylvania until 7:00 a.m. on Election Day.

Is the clerk is going through absentee ballots, finding the ones that would not be counted, and then, if the person voted Democratic, contacting them so they can vote correctly.

If true, that's cheating.

"If" being the largest word in the English language.

The Department of State quickly stopped the automated emails and updated them Tuesday morning to send the correct information, spokesperson Wanda Murren said. “The Department will also continue to send out additional emails to voters falling in these codes to inform them of their option to vote by provisional ballot,” she said. The updated emails tell voters they “must take further action” for their votes to count. “Don’t miss your chance to vote,” the emails say, “take action today!”

Counties are still handling flawed ballots differently. Some are going further than others to try to reach voters, and some counties aren’t following Marks’ directions to cancel ballots. Philadelphia officials had been setting clearly flawed ballots aside for the last several weeks. This week, they are marking them as canceled and considering direct outreach to affected voters, who can request replacement ballots or use provisional ballots on Election Day. Delaware County officials had planned to reach out to voters to help them fix their ballots, but will now mark them canceled and rely on the state’s notification emails to reach voters.

Bucks County has been sending postcards to voters they can’t reach by phone or email. “We want to help everyone make sure their vote gets counted,” said Gail Humphrey, chief clerk for Bucks County. “So we’re going to take the extra effort to make sure that happens the best we can.”

In Montgomery County, elections officials aren’t marking flawed ballots in as canceled. Staffers are instead reaching out to voters to tell them they can come in and complete any missing information on their envelopes, request a replacement ballot, or use a provisional ballot.“We’re not accepting them, so they’re not scanned in and we’re not canceling them,” said Lee Soltysiak, the county’s chief operating officer and chief clerk of its elections board. “We’re giving people the opportunity to cure.”

Which says you can't sue for a problem you created? Ie, you can't seek relief for a situation you caused.

Seems apropos in this case and should remove any standing of the GOP to complain.

which mail ballots won't be counted until tomorrow. Mine of Monroe is heavily Democratic. I have voted for 50 years in 3 different states; nine of those years by mail in ballot. Received an email from my County BOE that my ballot was received on October 14th. THAT email on my computer is legal enough proof my ballot was received in well enough time to be counted; on or AFTER election day.
