East Texas judge sets deadline for Pence in Gohmert lawsuit

A judge in Tyler Congressman Louie Gohmert’s lawsuit against Vice President Mike Pence has set a deadline for when Pence should respond to Gohmert and the other plaintiffs’ emergency request.

Gohmert’s lawsuit, which was filed Sunday, states certain parts of the 1887 federal law, Electoral Count Act, are unconstitutional, and the litigation claims election fraud. The lawsuit would be withdrawn if Pence (and Congress) appoints President Donald Trump as president for a second term.

On Tuesday, plaintiffs in the case requested a shortened time for response and a scheduling order from the judge.

On Wednesday, District Judge Jeremy D. Kernodle, of the United States District Court for the Eastern District of Texas in Tyler, set Pence’s counsel’s response due date as Thursday by 5 p.m. He also set Gohmert and the other plaintiffs’ reply due date as Friday by 9 a.m., according to court records.

1. I hope Biden's lawyers are briefing the court, not just Gohmert's and Pence's.

This lawsuit is insane.

What else do you call folks who believe their opponents drink babies blood and run child prostitution rings?

Most folks are equipped with built in BS meters. In science it's called a statistical significance test. A significant portion of our population has had their BS meters short circuited. In stead of listening to arguments and being able to tell when someone is blowing sunshine up their arses, they've been conditioned to evaluate if the person is part or the "educated elite" (scientists), people of color, women or socialist/communist (Democrat) and dismiss anything said by such group.

6. How can Pence decide whats Constitutional? Thats what this suit says its about.

So the COURT should decide, not Pence.
Or, you could look at it like blackmail

8. What the hell is wrong with that 'judge'? That bogus lawsuit should have been tossed immediately.

Nobody, not even Pence, should have to waste one bit of time responding to such obviously unconstitutional bullshit.

What scares me, at least a little bit, about all of this is what happens in the future if we win a somewhat close election? Will the radical right be able to find a judge to toss the results out of one state and flip the results?

9. The Time Limits for Briefing Are So Tight that the Court May Not be Fully Briefed

although it forces Gohmert's attorneys to work over New Years Eve which is nice. I would be a little concerned that poor briefing could result in a bad opinion

11. This has to be the most convoluted piece of litigation in the history of this country

It's difficult to even understand what the plaintiffs are asking of the judge.

If I understand this correctly, they are asking a federal judge in TEXAS, to rule that the Vice President has the ability to overturn and replace the state elector slate of any state that the Vice President sees fit to.

It seems that if the judge ruled in favor of this, the judge would have to determine
1.) Parts of the 1887 federal law, Electoral Count Act, are unconstitutional
2.) There was election fraud in Georgia, Michigan, Pennsylvania and Wisconsin
3.) That the Vice President has the authority to pick and choose who will win the election by determining between
legally appointed elector slates or fake ones

This judge must have issues to accept this case to begin with. How can a federal judge determine all those issues?

What happens if the judge finds for the plaintiffs? Insane I know, but just look at the last four years.

My guess is that it would immediately go before the SC. But what if the SC did not rule on it?

I think the Republicans are kicking the slats out from underneath the bed. If this insane sh!t keeps up and we start getting strange anti democratic rulings from strange judges, this is not going to turn out well.
