Dominion files $1.3 billion defamation lawsuit against MyPillow CEO Mike Lindell

Dominion Voting Systems on Monday sued MyPillow CEO Mike Lindell for more than $1.3 billion in damages, alleging that the Trump ally exploited the baseless conspiracy theory that Dominion's voting machines rigged the election for Joe Biden to sell more pillows.

The big picture: Lindell is the latest Trump ally to face a multibillion-dollar lawsuit from Dominion or Smartmatic, another voting machine company subjected to a campaign of false claims about the election.

  • Pro-Trump lawyers Sidney Powell and Rudy Giuliani have each been sued by Dominion for $1.3 billion in damages.
    Earlier this month, Smartmatic sued Powell, Giuliani, Fox News and some of the network's top hosts for $2.7 billion.


  • Lindell, who received a cease-and-desist letter from Dominion in January, told Axios at the time: "I want Dominion to put up their lawsuit because we have 100% evidence that China and other countries used their machines to steal the election."

    What they're saying: "Lindell’s statements have exposed Dominion to the most extreme hatred and contempt. Lindell himself called it the “biggest crime ever committed in election history against our country and the world," Dominion wrote in its 115-page complaint.

    they are going to sue everyone they can in hopes to clean up from settlements done by all of them.

    (it would be nice if they were able to take out Lindell though )

    but I have to say it's fun seeing the tables turned, a soul sucking corporation suing an unmitigated jackass instead of a whistleblower or left of center ethicist.

    I can see Lindell going through lawyers almost as fast as Dumdum did. He's a true believer in his own horse shit.

    By destroying the bullshit of rigged elections, an enormous cloud of doubt will be cast over all the other conspiracies. It's a domino. How many elected Republicans labeled themselves with the conspiracy of a rigged election? How many have conveniently forgotten about the role that Trump had on 1/6, now that the dust has settled?

    This all needs to be very public. Every detail needs to be made clear to the public.

    This is so much more than suing a handful of idiots.

    I'm not an attorney, so I don't really know how such things work.

    Does it count as libel, slander, or defamation if the person making the accusations actually believes them? I don't know if this Lindell character really believes what he's claimed, but if he does, does that afford him some protection?

    (I'm hoping the answer is "no," by the way.)

    If the person defamed was a private person, in most states, the person making the defamatory statement can only be held liable for defamation if he/she: knew that the statement was false and defamatory, or. acted with reckless disregard of the truth or falsity of the statement in making the statement, or acted negligently in failing to ascertain whether the statement was true or false before making it. To act in reckless disregard of the truth or falsity of a statement means that the person making the statement had serious doubts as to the truth of the statement, but they went ahead and made it anyway.

    So, two point, it depends on state law, so where they file the case counts, and given the outlandish nature and claims to have evidence without there being evidence, it sound like negligence might be easy to prove. And if you say you have evidence, then are unable to provide it, you could argue it was known to be false.

    which I believe they are, then Dominion will become the World Leader in this field.

    The profits could make these amounts seem like pocket change if that occurs.

    They have a lot riding on this case - I doubt their will be a private settlement. They probably will settle publically so will require the truth and evidence to be put out there for all to see.

    And Mr. Lindell is going to have to eat shit on national TV when he apologizes.
