A pair of federal judges on Monday publicly aired their grievances when denying an Indiana prisoner’s appeal for compassionate release from prison over health risks posed to inmates by the COVID-19 pandemic.

Circuit Judge Karen Nelson Moore, an appointee of Bill Clinton, took to task her Sixth Circuit Court of Appeals colleague Circuit Judge Chad Readler, an appointee of Donald Trump, after Readler dismissed her use of infection rate statistics and death counts in her analysis in the case of Kwame Amin Mathews. Mathews is a federal inmate who six years ago “pleaded guilty to aiding and abetting the distribution of cocaine base,” was sentenced to 151 months in prison, and who now “suffers from multiple sclerosis.”


The opinion plays out somewhat like a dialogue, with Moore opening in the form of the court’s majority decision.

“By the end of 2020, one in every five persons incarcerated in the United States had tested positive for COVID-19,” Moore’s opinion began. “At least 275,000 imprisoned persons across the country have been infected; more than 1,700 have died. A court’s refusal to reduce an incarcerated person’s sentence could result in death.”

The statistics Moore cited were sourced from weekly databases kept by The Marshall Project and the Associated Press, which both derived the data from each federal prison agency and verified those figures with officials............................................................................

is a little full of himself, among other things. Isn't "Chad" the equivalent of "Karen?" You would think being a "tRump appointee" would humble a person a bit, but then that would require self awareness.

Especially in the chronic use of the colleague's own rulings against him.

That said, it's beating a dead horse. I'm finding myself bemused by the frequency of "bombshells," "shreddings," and "destruction" that takes place contra Trumpanzees. Those who already don't respect Trumpanzees do not need more ammunition, and those who will respect them no matter what will not be swayed by footnotes ten times longer than Judge Moore's, because the facts are irrelevant and foolish consistency is for small minds. In such an atmosphere, it is understandable that the frustrated will applaud such "devastating" victories, but if one peruses the media of the other side, one will find that for them the "victory" goes all the other way. cf Mr Trump's debate with Mr Biden, which both sides claimed to "win." As if it made a difference.

From what I understand when the ABA rates judges who are put forward by the President, they look at the quality of opinions written by that judge.

So, in a normal world, where judges who are deemed unqualified by legal organizations are not promoted, these sorts of incidents would prevent upward mobility. But the (R)'s in the last 4 years have shown that they no longer worry about anything but the Federalist society position on a judge.

Maybe, in the future, the home state black ball and an 'unqualified' rating from the ABA will go back to meaning that judges appinted by both parties will at least be competent and qualified.

It was that system that led to many (R) appointed judges doing the right thing and throwing out the Trump lawsuits.

It was ignoring that which gave us Kavanaugh and Barrett and all sorts of pretzel logic to prevent Trump from accountability.

than outside. One in 5 infected, probably a pretty solid figure based on testing, would be probably 2 to 3 times the rate for people outside depending on which estimates for outside would be more accurate.

didn't try to tack that down. Now that the CDC is no longer being sabotaged by Trump appointees, and after repairing what has to be, it'll be getting back to its previous "gold standard" performance, including producing figures good decisions can be based on.

The whole planet's missed them.
