White House says Biden is prepared to issue executive orders on guns

In the wake of two mass shootings in the U.S. in a single week, the White House said Friday that President Biden is prepared to issue executive orders to enact gun reform, circumventing the need for a divided Congress to pass legislation.

White House press secretary Jen Psaki told reporters at a briefing that she couldn’t offer an “exact time frame” on when those orders would move off Biden’s desk, but said they were “one of the levers that we can use ... to help address the prevalence of gun violence and address community safety around the country.”

Biden, however, made clear during his Thursday afternoon press conference that infrastructure rather than gun reform would be his next legislative priority, which led to complaints from gun control activists and progressive Democrats.

Psaki said Biden understands their frustration and suggested that their ire be directed toward those members of Congress who are voting to block gun control legislation.

Executive Action seemed to work for trump, why not Biden.

The average American will take more notice if an issue is pushed to top priority.
If people see action being taken, they'll let their voices be heard.
We know that the majority in this nation want common sense reforms.

26. I think a number of Trump's executive actions were nullified by the courts

Executive actions are increasing taking the place of legislations, but it seems constitutionality is still more-or-less needed.

Imagine it being upheld.

Then a president gets in and uses executive action to outlaw anything in the Bill of Rights.

The song would change in a heartbeat.

You either defend all rights or you defend none.

27. There is also the possibility that the court nullifies it

but the executive ignores the ruling. If it is an issue with sufficient partisan support, I think the President could do it.

6. There isn't a whole lot he can do

With an Executive Order. He can only ask Congress to move something, and he can propose lots of things, but there is little within his authority in an Executive Order.

to Capitol Hill. He said earlier this week that he believes his administration can guide a narrow Democratic majority in the Senate to pass two gun reform bills kicked over from the House of Representatives, despite multiple failed attempts of previous administrations to get comprehensive laws on the books.

The bills passed by Democrats in the House would require background checks to be performed for all gun purchases and transfers and would close the so-called Charleston loophole, which in some instances allows gun sales without a completed background check.'

11. His options are quite limited.

He could limit imports of "assault weapons". He could direct the ATF to consider 80% receivers to be actual fireams (this would certainly be challenged in court). He could also direct that local law enforcement authorities be notified if someone fails an FBI background check to buy a gun from a registered dealer.

He cannot mandate universal background checks, or ban the sale of "assault weapons" and "high" capacity magazines. Those actions would require legislation.

Demand ‘universal background checks”?

Based on logic and previous comments, it’s doubtful he can issue an EO to ban assault weapons, but if we can get universal background checks, that could help.

Alas, it appears his EO’s may be a weak bandaid meant to sooth the broken hearts of Americans.

But, we need to get our Legislators to do the heavy lifting. Was hoping the NRA would be sufficiently weakened by now to finally break thru their influence in DC.
