Nebraska will not join others in calling for convention of states to amend US Constitution

Source: Omaha World Herald

By Martha Stoddard

LINCOLN Efforts to call for a convention of states to rein in the federal government fell two votes short in the Nebraska Legislature Friday.

State Sen. Steve Halloran of Hastings failed to win the 25 votes needed to pull his Legislative Resolution 14 out of the Government, Military and Veterans Affairs Committee for debate by the full Legislature. The eight-member committee is deadlocked on the measure.

The resolution would add Nebraska to a list of 15 states already calling for a convention of states as described in Article 5 of the U.S. Constitution.

Article 5 provides for such conventions as one way to propose amendments. The article requires that at least two-thirds of the states, or 34, apply to Congress for such a convention to be called.

2. I read about it a couple years ago. It has no chance in hell of happening.

12. Why?

There have been countless posts on DU suggesting needed changes to the Constitution. How do people think any of those would ever happen?

15. So are all the calls for changes in the Constitution just academic exercises?

And not at all serious?

16. Not this way...this is a method to destroy the constitution devised by red states who are the

only ones who have signed on...and consider that they outnumber us.

3. The Koch's has been pushing for years to a constitutional convention to take over the country

I bet those who voted against are going to get a Koch financed and trained opponent next election time. All these crazies we have now that started with the tea party are Koch activists.

5. People need to dial back the hysteria about this possibility...

The "hair on fire" alarmists always seem to frame it as, if enough states call for a convention, such an assembly meets and can drastically rewrite the U.S. Constitution by itself, and the result automatically becomes the new law of the land. That's simply not true -- even if such a convention were held, any revisions adopted by it still would have to be ratified thereafter by three-quarters of the states, just the same as if a proposed constitutional amendment were passed by Congress. It's not some tricky way of instituting a covert coup, folks.

7. Granted, Republicans don't have 38 State Legislatures currently...

But I don't think it was that long ago that they had 33.

6. Beware...that is how Hugo Chavez began his rape of Venezuela, by changing the constitution

A little change here, a little change there, and then another one over there and suddenly the people are all screwed.

Totalitarians love to rape the constitutions because in their original form constitutions do not work well for totalitarian regimes.

11. Sadly with the current degeneration of political discourse

We would end up with a constitution worse than the one written by slaveholders.
