WASHINGTON A federal grand jury in Michigan returned a superseding indictment today that adds new charges of conspiracy to use a weapon of mass destruction against three defendants and adds federal firearms violations against two defendants in the case alleging a conspiracy to kidnap the governor of Michigan, Gretchen Whitmer.

16. Reading through the charging document-

The count mentions "improvised explosive device containing shrapnel" and another refers to "inspect the underside of a highway bridge for a place to mount an explosive charge".

I think this means the D.O.J is getting a little 'irritated' about these guys.

Couldn't happen to a nicer bunch of people.

In my humble opinion.

21. That's a likely result if they take their case to trial

I took a look through the US sentencing guidelines and posted my analysis in post 20. The base offense is 121-151 months if there is no prior criminal history, but there are enough adjustment factors in play to bring the sentence up to life imprisonment.

I'm not a lawyer, but offering a guilty plea in exchange for a recommended 324 month (27 year) sentence is probably the best they can do.

I, as in any of the rest of us who abide by the law. If I was on the jury, I'd throw the book at him until it hurt so bad he bled, then I'd throw it at him some more until his parents were utterly and completely ashamed of him that they'd disown him.

Traitors who thought they were shielded to commit atrocities should get what's coming to them. And that includes all those IN POWER who said they would shield them to perform atrocities.

20. These defendants are likely to spend quite a bit of time behind bars.

Sentences usually run concurrently and the kidnapping charge will likely be the charge that carries the longest sentence. The sentence base level is 32, but 2 levels are added for the usage of dangerous weapons, 6 levels are added because the offense was against a government employee, and 6 levels may added for demanding a ransom (assuming their intent was to demand changes to coronavirus restriction in exchange for the governors release) but then 3 levels get taken away because it was conspiracy and not yet acted on. That results in an offense level of 43, which carries a recommended sentence of life imprisonment.

Ty Garbin plead guilty and is awaiting sentencing. Given the admission of guilty, he's eligible for a 2 level "acceptance of responsibility" reduction, which would put his sentencing guideline at 324-405 months.
