Expert says William Barr now faces a potential 'criminal investigation'

Judge Amy Berman Jackson, the federal judge who gave prison sentences to two of former President Donald Trump's close allies — his 2016 campaign manager Paul Manafort and veteran GOP operative Roger Stone — was highly critical of former U.S. Attorney General William Barr in a recent ruling, describing his response to the Mueller Report as "disingenuous." And legal expert Neal Katyal, who served as acting solicitor general under President Barack Obama, described Jackson's comments as highly damning during an appearance on MSNBC's "Deadline: White House" this week.

Host Nicolle Wallace, a Never Trump conservative who served as White House communications director under President George W. Bush, told Katyal that Barr "misrepresented" the "conclusions" that Barr reached after former Special Counsel Robert Mueller wrapped up the Russia investigation — asking Katyal to weigh in on the "political damage" that Barr did to the United States. And he responded that it gives him no pleasure to have been right when he appeared on MSNBC in 2019 and said that Barr was distorting the Mueller Report.

The 51-year-old Katyal told Wallace and Washington Post reporter Carol Leonnig — who also appeared as a guest — "I'm not sitting here feeling good about the fact that I and so many others were right two years ago. I mean, I desperately wanted to be wrong. And our system is set up to trust the attorney general. I mean, Barr was the attorney general of the United States, not the attorney general for President Trump. That's what he was supposed to be — he was supposed to be for the people. But unfortunately, there was always a degree of corruption around him, and he constantly acted like one of Donald Trump's personal attorneys."


Katyal continued, "And now, with the new decision by the judge into his deception, he's finally being treated like one of the gang — which he always was…. What you have in this decision by the judge yesterday — by Judge Amy Berman Jackson, who is a meticulous judge — is a statement that no, Barr actually lied to the court and to the American people. She called, you know, Barr's actions, in the litigating position, disingenuous, which is something you almost never hear a federal judge say about any litigant — particularly not someone from the Justice Department and particularly not the attorney general of the United States."................................

I hope something sticks to put Barr out of business!



The Justice Department should take strong disciplinary action against the OLC attorneys who lied in sworn affidavits to Judge Jackson, and it needs to investigate the matter criminally. That means looking into whether Barr conspired with them.

2. I'll believe it when I see it.

It's been almost 4 months since the orange thing left office and I'm still waiting for New York or someone else to prosecute him. Jabba the barr is a legal professional so he'll know how to stay out of jail.

7. My thoughts exactly

Every corrupt republican is facing some sort of prosecution. Facing it. Never actually experiencing it. SDNY supposedly had their case airtight and they were waiting for Donnie to leave office. He does, and crickets. The woman with the rape charge against Donnie, who was all set to go. Where is she? Rudy. Gaetz. Now Barr. The press says "Oh, they're in trouble now!" and their lives go on as normal with no action taken against them. Is everyone too cowed and afraid of them to actually DO anything but talk about it?

Gaetz's criminal behavior has virtually nothing to do with holding office. The others you mention -- tangled up in official duties and (some variation of) qualified immunity. (although we'll have to see how that plays out with the former one -- and things that happened before taking office). But Gaetz is clearly the odd man out here.

any sort of prosecution (or legal penalty) for Barr -- as even more unlikely. The talking heads on TV can fill their time slots -- but please wake me up when you see a real indictment ...

We used to punish the powerful, now they have too much power. If Barr faces charges, he can take a LOT of people with him, so they will do everything to keep him safe.

14. So which of these OLC attorneys gave sworn affadavits to Jackson? I can't find info on them.

Steven Engel, Assistant Attorney General

Henry Whitaker, Deputy Assistant Attorney General
Liam Hardy, Deputy Assistant Attorney General
Jennifer Mascott, Deputy Assistant Attorney General

These four variously either served under Scalia or Thomas or went to conservative schools or teach at conservative schools.


Jackson ruled that one of the documents, described by a Justice Department official as an “untitled, undated draft legal analysis” that was submitted to the attorney general as part of his decision-making, was properly withheld from the group.

But she ordered the release of the other memo, which concludes that the evidence assembled by Mueller’s team would not support an obstruction prosecution of Trump.

In her order, Jackson noted that the legal memo prepared for Barr, and the letter from Barr to Congress that describes the special counsel’s report, were “being written by the very same people at the very same time.

“The emails show not only that the authors and the recipients of the memorandum are working hand in hand to craft the advice that is supposedly being delivered by OLC, but that the letter to Congress is the priority, and it is getting completed first,” the judge wrote.

Whoever worked out the end game of the Mueller report with Barr should be sweating bullets by May 17, which is when she wants that memo. Because she already knows who likely lied in sworn affadavits to her.

Barr is an asshole and has burned his bridges with biglaw. It is clear that Barr needs to worry about prosecution or other steps
