Prosecutors Seek 30 Years for Derek Chauvin in George Floyd Murder

Prosecutors on Wednesday said they are seeking a 30-year sentence for former Minneapolis police officer Derek Chauvin, convicted in April of the murder of George Floyd, while his defense attorney asked for less than the 15-year maximum in state sentencing guidelines or probation.

Defense Attorney Eric Nelson also made his most extensive argument yet that Mr. Chauvin should be granted a retrial because of what he called prosecutorial and juror misconduct and errors by the judge, particularly in not granting a change of venue.

Mr. Chauvin is expected to be sentenced June 25 after being found guilty in April of second-degree unintentional murder, third-degree murder and second-degree manslaughter after kneeling on Mr. Floyd’s neck and back for more than nine minutes as he lay handcuffed in a prone position.

The maximum sentence for second-degree murder is 40 years, but state sentencing guidelines recommend up to 15 years for a person with no criminal history.

what I've read and heard, Chauvin has plenty of history.

From what I've read, the sentencing guideline would be 12.5 years and it takes some aggravating factors to get it up to 30 years.

IOW - I think they're asking for the maximum possible sentence for the crimes involved.

Of course, there's still the possibility of a federal prosecution

They made an unserious offer of time served + probation. For murder.
Prosecution had little choice but to go to the other extreme.
Had the defense come up with 7 years plus 5 probation, prosecutors might have recommended something less harsh.
But, the defense just had to minimize the seriousness of the offense.

I know he won’t get that, but I suspect his life in prison will be hell. Bad cops are probably not the most popular people there.

Much less 30 years.

Are they going to put him in the general prison population?
