Death penalty still an option for NYC federal prosecutors despite Attorney General's moratorium

A moratorium on the death penalty will not stop federal prosecutors from pursuing capital punishment on a case by case basis, the U.S. Attorneys Office in Brooklyn said Wednesday.
Attorney General Merrick Garland said on July 1, that all federal executions would be halted as the death penalty procedure is reviewed.
A Brooklyn judge asked federal prosecutors how the decision will impact a Queens case where 12 members of the 18th Street Gang are accused of three murders between 2016 and 2018.
The Memorandum [from Garland] has no effect on the status of this case, Assistant U.S. Attorney Jonathan Lax wrote in court papers.

The moratorium was on scheduling new executions while the policy is reviewed.

Guiliani, the guy who did nothing to stop 3000 New Yorkers from dying on his watch, was a Rethug prosecutor in New York.

Last time I checked, Joe Biden was President, and Mark Lesco (a Democrat) was Acting US Attorney. Individual prosecutors (Asst. USAs) don't set their own policies on Capital cases.
