Federal Appeals Court Panel Unanimously Declines to Block Biden Administration's Eviction Moratorium

A week after one Donald Trump-appointed federal judge allowed the Biden administrations eviction moratorium to resume, another from the court of appeals joined a unanimous three-judge panel in refusing to block the emergency measure.
The development potentially tees up another anticipated Supreme Court battle pitting a coalition of realtors, landlords and management companiesled by the Alabama Association of Realtorsagainst President Joe Bidens administration.
On June 2, 2021, this court denied a previous motion to vacate the stay imposed by the district court, U.S. Circuit Court Judges Cornelia Pillard, Neomi Rao, and Ketanji Brown Jackson noted in a single-page order. The district court has since denied plaintiffs emergency motion to vacate the stay pending appeal. In view of that decision and on the record before us, we likewise deny the emergency motion directed to this court.
Circuit Judge Rao is a Trump appointee. Circuit Judges Pillard and Jackson were appointed by Barack Obama and Joe Biden, respectively.

(328 posts)Are the landlords salivating at the prospect of renting to all those homeless people who have money and can pay the rent? Not if they are smart. The 'homeless people' will be the ones they just evicted. They'll scrape up a deposit and a month's rent, and never pay a dime more if they can't. Musical Apartments.
Are the banks salivating at the prospect of evictions, followed by repossessing rental properties. You betcha they are. That wipes out the landlord's equity, and the banks get to sell them all over again.

I have a rental and the tenant is behind 4 months.
Is it because he can't pay? No. The tenant is employed and can pay the rent.
But because the moratorium applies to everyone, they just don't pay because they don't want to. They're protected.
This is abuse of the system, but it's considered legal.
So they don't pay, I can't evict them, but I still have to make the mortgage payments on the house.
How is this fair?
If you think it is, please explain it to me, because I can't figure it out.

(989 posts)Is that many landlords are people like you and my parents, who are are a far cry from evil, faceless entities or slumlords like Kushner who are only concerned with the bottom line.
